By [[letter::05000302/LER-1980-002-03, /03L-0:on 800105,following Normal Reactor Shutdown,Chem/Rod Sampling Revealed Reactor Coolant Dose Equivalent I-131 Exceeded Tech Spec Limit.Caused by Leaking Fuel Pins & Anticipated Iodine Transient Following Shutdown|letter dated January 28, 1980]], you withdrew the October 31, 1978, Technical Specification Change Request No. 34 for Crystal River Unit 3 and requested that the Class III fee of $4,000 paid for that application be refunded to you. The Nuclear Reactor Regulation review staff has advised us that no action on your Request No. 34 had commenced.

Under the provision of 170.12(a) the Comission may retain fees for withdrawn applications. However, since no review of your application was started, we have concluded that an exemption pursuant to 10 CFR 170.ll(b) from the fee requirements is hereby authorized by law and is otherwise in the public interest. On this basis, we have authorized our Office of the Controller to refund a sum of $4,000 to your Company. The refund will be sent to you as soon as it can be processed by the Controller's office.
