This refers to the inspection conducted by Messrs. C. J. Paperiello and C. T. Oberg of this office on October 22, 1979, of activities at Wehr Steel Company authorized by NRC Byproduct Material License No. 48-02005-02 and to the discussion of our findings with you and other members of your staff at the conclusion of the inspection.

The inspection was an examination of activities conducted under your license as they relate to radiat;on safety and to compliance with the Commission's rules and regulations and with the conditions of your license.

The inspection consisted of a selective examination of procedures and representative records, observations, independent measurements, and interviews with personnel.

During this inspection, certain of your activities appeared to be in non-compliance with h3C requirements, as described la the enclosed Appendix A.

This notice is sent to you pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations.

Section 2.201 requires you to submit to this office within twenty days of your receipt of thi notice a written statement or explanation in reply, including for each item of noncompliance: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date wh:n full compliance will be achieved.

During this inspection, Mr. Schmitt stated you have not established a quality assurance program for packaging radioactive materials as outlined in 10 CFR 71.

In addition, we understand that you have not packaged and shipped any radioactive material since you received the cobalt-60 sealed sources presently in use.

Please inform us immediately if our under-standing of this is not correct.

This is to advise you that before you package or repackage any radioactive material in a shipping container for shipment you must file with the Di-reccor, Office of Nuclear Material Safety and Safeguards, of the 53C, a description of, and receive approval for, your quality assurance program in accordance with 10 CFR 71.51.
