SUMMARY

Week Ending February 16, 1979 Otonee Units 1 and 2 Duke Power Company submitted a. proposed license amendment to increase capacity of the spent fuel storage pool shared by Oconee Units 1 and 2.

Duke is concurrently pursuing a Part 70 license' change to permit the shipment and storage of Oconee spent fuel at the McGuire Unit 1 pool.

Duke requested approval of the capacity increase at Oconee by June 1979.

NRC previously issued a. license amendment authorizing increased spent fuel storage 'in the Oconee Unit 3 pool.

Northwestern University On January 26, Northwestern University (NU) submitted an application for a construction permit and operating license for the research reactor from Oregon State University.

Northwestern University requested a review schedule to permit reactor operation in time for classes commencing this Fall.

Meeting with CEO NRC met with the Council on Environmental Quality (CEQ) on February 14 to discuss NRC implementation of the recently published CEQ regulations for NEPA review. As a result, ELD is pr*. caring an analysis of possible impacts of the CEQ regulations on the NRC regulatory program.

. e_etina with EPA on Clean Air Act NRC met with EPA's Office of Radiation Programs on February 15 to discuss EPA's plans for implementing the' Clean Air Act as it relates to radio-active materials.

Meeting with DOE Concerning Office of Waste Isolation and WIPP On February 6, NRC met with DOE and their consultant, Battelle-Columbus to obtain an overview of activities relating to the Office of Nuclear Waste Isolation, the WIPP project and the programs at Hanford and Nevada Test Sites.

During the meeting, ONWI indicated that the earliest they could have an application to NRC for a geologic repository construction ~

authorization would be January 1982.

US-USSR Cocoeration Prooosal IP expects to forward to the Commission a paper on the proposed US-USSR cooperation agreement. All NRC offices and the Executive Branch have concurred.

i Safeguards Consolidation Study A study on the feasibility and advisability of consolidating NRC's safeguards functions in NMSS was sent to the ED0 for review.

- 2 Differing Professicnal Ooinions A,first draft of NRC policy and procedures for resolving differing views was sent to office directors for review and comment.

-Yellow Book Changes For the next year, a modified version of Yellow Book (Construction Status P.eport, Nuclear Power Plants, NUREG-0030) will be published at approximately four-month intervals.

Starting in 1980, an automated version of the book

Calvert Cliffs

,In response to staf f questions regarding the future use of charging pumps as an CCCS subsystem, Baltimore Gas & Electric Company (BG&E) reported on February 9,1979, that credit has been assumed in the '

small break LOCA analysis for stretch power (2700 MWt) operation of-both

vert Cliffs units since March 1977. The staff had not been informeo of this assumption in previous stretch power level or cycle reload applications from BG&E. After receiving confirmaticn from the fuel supplier (Combustion Engineering) that an approved small break LOCA analysis for 2560 MWt existed, BG&E informed the staff that they would limit the power level of both Calvert Cliffs units to 2560 MWt until this issue is resolved. This is a power decrease of about 100 MWt for each unit. The units had been operating at less than their licensed pcwe.r of 2700 MWt because of the 10 F condenser AT limit of the Environmental Technical Specifications and the Maryland State NPDES'.

Oconee Units 1 and 2 By letter dated February 2,1979, Duke Power Company submitted a proposed license amendme,nt to increase the capacity of the spent fuel storage pool shared by U, nits 1 and 2, from 336 fuel assemblies to 750 assemblies.

Duke is concurrently pursuing a Part 70 license change to permit the shipment and storage of Oconee spent fuel at the McGuire Unit 1 pool.

Duke requested approval of the capacity increase at Oconee by June 1979.

The NRC has previously issued a license amendment authorizing increased spent fuel storage in the Oconee Unit 3 pool.

Ncrthwestern University Northwestern Uni.versity submitted an application, dated January 26, 1979, for a Constr.uction Permit and Operating License.

They have negotiated with Oregon State University to transfer their AGN-201 (Docket No. 50-106 Ser 114) research reactor to Northwestern University.

They have requested a review schedule to carmit Nr"chwestern University to complete construction and ccamence operations for classes to commence the Fall of 1979.

IMPORTANT EVENTS FOR THE WEEK ENDING FEBRUARY 16, 1979

- l' Meeting with EF on Clean Air Act:

Representatives from SD and NRR met with represt. itatives from EPA's Office of Radiation Programs on -

February 15, 1977, to discuss EPAs plans for implementing 'the Clean Air Act as it re ates to radioactive materials.

The Clean Air Act sp.ecifically regi ires.that the EPA Administrator determine, by -

August 1979, whe 1er radioactive materials constitute a potential pollutant.

It almost a certainty that this decision will be' affirmative, bt, 2t will probably not be made before the required date. Simultaneuus with making this decision, EPA must also classify radioactive pollutants into one of the types (" listings") specified in the Act (e.g. ambient standards, non-threshold pollutants, and threshold pollutants). The Act also requires that if EPA classifies radioactive materials as a pollutant, it must issue proposed emission standards within 6 months.

EPA presently expects that it will be able to conclude that its existing regulation 40 CFR 190 represents ALARA releases, so that conformance with it will satisfy the Clean Air Act for reactors and probably also other fuel cycle facilities. Other classes of NRC-regulated facilities and activities will have to be -

addressed individually.

It was agreed that periodic meetings between EPA and NRC representatives on specific topics would be arranged to enable an exchange of views as EPA develops its standards for radioactive materials under the Clean Air Act.

Meeting.with CEQ on Imolementation of 40 CFR 1500-1508:

Reoresentatives of' ELD, OGC, NRR, SD and CEQ met at CEQ on February 14, 1979, to discuss' NRC implementation of the recently published CEQ regulations for NEPA review (40 CFR 1500-1508).

The focus of the meeting was a list of requirements in the CEQ regulations which have been identified by the NRC staff as requiring clarification or having high potential to significantly impact NRC's regulatory program, including:

a.

Consideration of alternatives when information gaps exist. --

This is of particular significance with respect to alternative sites in different media in high level waste repository licensing reviews.

b.

Requirement for " worst case analysis," including the probability of the event. -- This is of particular relevance to accident analyses for reactor license reviews and for high level waste standards.

c.

Inclusion of a " failure to act" category under the definition of major Federal. action. -

T is could be of significance for sugh actions as denials of petitions claiming significant ongoing environmental harm.

Also discussed was CEQ's authority to promulgate regulations which

HEW-Interagency Task Force on Radiation Effects: SD representatives attended a meeting of the Interagency Task Force on Radiation Effects at HEW February 14, 1979.

Peter Libassi, Task Force Chairman,'

stated that he hoped to release the Work Group Reports for public comment by February 21 or 22.

He also annctnced that he hopes to be able to release a memorandum on -Institutional Arrangements at the same time.

He requested comments on the latest versions of all Work Group Reports from Task Group members by the morning of February 15.

In addition, with respect to the Institutional Arrangement Memorandum, he requested that all Task Group members provide their thoughts on problems, objectives, issues and alternatives by noon February 15.

During the meeting, Mr. Libassi asked if there were any major issues of dissent. The D0D representative expressed considerable concern about the public information report and as a result this report will. undergo extensive revision. The NRC representative (Robert B. Minogue) furnished' comments to Libassi's staff on this report on February 15'and on the Institutional Arrangement Memorandum on February 16.

Final Policy Statement Reaardina NRC's Future Role in Reculating the Medical-Use of Radioisotooes:

The Commission's final policy statement regarding NRC's future role in regulating the medical use of. radioisotopes was published in the Federal Register on i

February 9, 1979.

In the three-part statement the Cormission said that:

a.

The NRC will continue to regulate the medical uses of radioisotope's as necessary to provide for the radiation safety of workers and the general public.

b.

The NRC will regulate the radiation safety of patients where just-ified by the risk to patients and where voluntary standards ~

or compliance with these standards are inadequate.

c.

The NRC will minimize intrusion into medical judgments affecting patients and into other areas traditionally considered to be a part of the practice of medicine.

OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS Items of Interest Week Endino Februarv 16, 1979 Meetina with DOE Re Office of Waste Isolation (Battelle-Columbus)' and WIPP On February 6,1979, a meeting was held with representatives of the U:S.

Cepartment of Energy (D0E) and their consultant, Battelle-Columbus. The purpose of the meeting was to provide the NRC staff with an overview of the activities taking place at the Office of Nuclear Waste Isolation (Battelle-Columbus), as well as the WIPP project and the pro. grams at Hanford and tbs Nevada Test Site.

Mr. Sheldon Meyers, Director of Nuclear Waste Management, DO( stated that the meeting was the first of a series to be held for the purpose of information exchange between NRC staff and DOE.

Future meetings will be announced and open to the public.

The subjects presented included overviews of the ONWI program plan; technical studies, including program and system analysis; engineering and technology development; geologic explorations; facilities engineering; site qualification and licensing.

In addition, an overview of the WIPP project and the programs at the Nevada Test Site and Hanford were presented by DOE.

During the meeting, ONWI representatives indicated that the earliest they could have an application to NRC for a geologic repository construction authorization would be January 1982.

Therefore, they plan to submit a Preliminary Information Report (PIR) to NRC in April 1930, in'the expectation that it will serve as a basis for information exchange, including the preparation of a mini SER by the NRC staff and a letter bp ACRS. As indicated above, they intend to establish information exchange meetings with the NRC staff immediately.

It was stated that, because of the restrictions imposed by the Armed

' Services Committee of the House of Representatives on the use of funds for activities related to obtaining a license from the NRC for the WIPP facility, DOE is precluded fr om establishing liaison with NRC on this subject. As a. consequence, design decisions important to safety are being made without interaction with the NRC.

This was a significant step forward in dealing with DOE on Waste Managd:ent issues. DOE now seems quite open to NRC and public scrutiny rof their overall program. We foresee continuing this type of interaction on a regular basis.

Procosed Meeting with Officials of " tate of New Mexico On February 9,1979, the Division of Waste Management received an invitation from the State of New Mexico to present our thoughts on the~

licensing procedures and requirements that may be applicable to a radioactive waste repository. Discussions on these matters are tentatively planned with Governor Bruce King, the State Sena.te Conser-vation Committee, and State officials associated with the WIPP facility.

Assessment of Environmental Imoacts of Technetium-99 from the Fuel Cycle The staff has studied a recent Health Physics Journal article dealing with Tc-99 environmental pathways to man, and has also analyzed the scenario assumed by EPA for the case in which Tc-99 was the major con-tributor of pupulation dose commitment. This scenario covered slow release by groundwater leaching of the contents of a high-level waste repository over a 10,000-year period. Staff analyses indicate that technetium can be the major contributor to population dose for some

- repository release scenarios and groundwater migration parameters but also shows that the total population doses are very small.

In as few as 60 cut of'more' than 1,000 scenarios and combinations of parameters studied by the NRC staff, -technetium was the major contributor to very lcw pcpulatiqn dose.

PH0-79-24 Zimmer Unit 1 - Meeting With Alleger - Representatives of Region III (Chicago) met with the person who submitted alle-gations regarding cable trays installed at the Zimmer Nuclear Power Plant.

The meeting was scheduled at the request of the alleger to disc'uss the scope and findings of the IE investigation.

This Preliminary Notification was issued because of expected local media coverage of the meeting.

PNO-79-25 and -25A Surry. Unit 2 - Fifteen Men Became Ill While Working in the Turbine Condenser - Fifteen men were taken to Riverside Hospital in Newport News, Virginia with an illness that was diagnosed as " metal fever".

Flame cutting of tubes was dis,

continued pending an investigation of the cause of the ' illnesses and checking the adequacy of ventilation. The reactor had pre-viously been shut down to replace steam generators.

IE Health Physicists on site confirmed that no radioactive contamination was present in the area of the condenser where these men had been working.

PN0-79-26 Carle Clinic, Urbana, Illinois - Report of an Exposure to a Nuclear Medicine Technician - A Nuclear Medicine Cepartment technician received an apparent exoosure of 22.6 rems whole body and 10.1. rems to the wrist as measured by TLD's. The expos'ure was received over a period of one month ending January 15, 1979.

Region III (Chicago) is investigating.

PNS-79-10 Duane Arnold - Threat Letter - An Iowa Electric light and Power Co. official received a threatening letter directed at the Duane Arnold Energy Center on February 10, 1979. This.~is the second such letter received by a company official from an orgcni-zation that threatened terrorism, kidnapping or sabotage if the-power station remained open. The utility planned to issue a press release disclosing general information about the threatening letter.

High Film /TLD Badge Readings - It was reported that a worker's personnel dosimeter indicated: whole body - 39 rems, skin -

. 39 rems, left finger - 31 rems, right finger - 28 rems, and wrist -

36 rems.

An investigation disclosed that the dosimeters had been left in the licensee's waste storage area; therefore, the exposures were not considered valid.

Indicaticns are that the worker's true whole body exposure was about.30 millirems..

On February 13, 1979 the Appeal Board issued an Order reversing a Licensing Board decision denying discretiona ry intervention to the Na tu r.al Resources Defense Council.

The Appeal Board approved and accepted a stipulation of the parties to the proceeding which sup-po rted the grant of discretionary intervention. As a result of the stipulation, NRDC withdrew its appeal claiming standing to intervene as a matter of right.

The parties agreed that the stipulation was not to be read as an admission by Duke Power that NRDC's allegations of harrassment of membership were ' valid.

The stipulation also provided that objections to the admissibili ty of NRDC's contentions could 8

continue to be made.

Kewaunee Nuclear Power Plant The Licensing Board issued an " Order Dismissing Proceeding" on Feb-ruary 5,

1979 in which the Board accepted the parties' settlement agreement. The Intervenors, the State of Wisconsin, the Licensee and the Staff had jointly moved the Board to dismiss the proceeding since the settlement had effectively removed all issues in controversy.

The settlement provided that the Intervenors would continue to be provided with documents related to the spent fuel pool including inspection reports and licensee event reports.

Atlantic Generating Station Units 1 and 2 On February 15, 1979 the Licensing Board issued an order dismissing this proceeding following notice that the utilities had withdrawn their application.

ITEMS OF INTEREST OFFICE OF INTERNATIONAL PROGRAMS WEEK ENDING FEBRUARY 16, 1979 INTER'1ATIbNALCOOPERATION Negotiations with Commissariat a l'Energie Atomioue Representatives of RES, IP and ELD met with Mr. Yves LeNiger, CEA, on February 14 in Bethesda.

This was one of a continuing set of meetings to negotiate a research information exchange arrangement between CEA and NRC in the area of fast breeder reactor safety.

US-USSR Cooperation Proposal IP has now received the concurrence of all NRC program offices and the Executive Branch in the proposed U.S.-U.S.S.R. cooperation agreement.

The Commission paper was delivered Thursday to ELD, who had already re-viewed it and comments had been incorporated.

IP thus expects no further clearance problems with the paper, which should reach the Commission early

~during the week of February 18.

Visit by Yugoslav Delegation A seven-member. delegation from Yugoslavia, composed of representatives of TEGRAD (Yugoslav Security Consultants) and their client, Nuklearna Electrarina Krsko (NEK), visited NRC on Thursday, February 15 for discussions with

. NRC physical security experts. Additional plans for the visit include a site visit.to Calvert Cliffs and to attend an International Conference in Los Angeles.

WEEK ENDING FEBRUARY 16, 1979 Emercency Precaredness Harold Gaut addressed a group of mid-western emergency preparedness specialitets who met in Kansas City, Missouri this week on the subject of Federal Interagency Assistance to S tate and local gover nments in Radiological Emergency Response Preparedness.

He also convened a meeting of the Regional.

Advisory Committee for Standard Feceral Region VII including I&E representatives from NRC Regions III and IV.

Representatives from Nebraska, Kansas and Missouri also participated in the meeting.

State Acreements A training seminar on Uranium Solution Mining for State and Federal Regulatory Personnel will be given in Corpus Christi, Texas March 6-9, 1979.

NRC and the State of Texas are jointly sponsoring this course.

Several Texas agencies, NRC offices (NMS S, IE, SP), the U.

S.

Environmental Protection Agency, and the U. S. Bureau of Mines will make presentations.

Louisiana has suspended.a radicgrapher's license following an inspection which disclosed several serious violations including use of untrained personnel to perform radiography.

Procram Develcoment On Monday, February 12, Tom Elsasser, Regicnal State Liaison Officer for Region I, met with Wendall Hannaford of the New York Office, Council of State Governments.

Areas of mutual interest between the CSG and NRC were discussed.

e OFFICE OF MANAGEMENT AND PK0 GRAM ANALYSIS Items of Interest Week Ending February 16, 1979 Decision Unit Trackinc and Policy, Planning, Procraming and Budcet Guidance Briefed the EDO.on the (1) status of the Decision Unit Tracking System Pilot Program, and (2) approach for developing policy, planning, programming and budget, guidance for FY 81-85. As of' February 12 six of 14 pilot program.

Decision Units are already tracking accomplishments. The remaining eight should be ready to track accomplishments by early March. The ED0 also concurred in our approach for developing the policy, planning, programming and budget guidance. Staff proposals for this guidance will be sent to the Commission in March.

Differing Professional Ooinions Sent to.0ffice Directors for review and comment a first draft of NRC policy and procedures for resolving differing views.

Yellow Book Chances The last monthly. issuance of Yellow Book, Construction Status Report, Nuclear Power Plants, NUREG-0030, was published presenting data as of December 31, 1978. For the next year, a modified version of this book will be published at approximately four-month intervals. This is in keeping with the finding of a recent study of the report.

Starting in 1980, an automated version of the book, reflecting user feedback is expected to be published. These changes to the book, when implemented,are expected to result in a cost savings to the-NRC and utilities.

Safeguards Consolidation Study Sent to the EDO for review the study requested by the Commission on the-feasibility and advisability of consolidating NRC's safeguards functions in NMSS.

Ccngressional O's and A's Draft responses to Congressmen Dingell and Udall were sent to the ED0 for his review and forwarding to the Commission.
