%...f CHAIRMAN The Honorable Manuel Lujan, Jr.
Committee on Interior and Insular Affairs United States House of Representatives Washington, D. C.
20515
Dear Congressman Lujan:
The NRC Authorization Bill for FY 1981, reported by the House Committee on Interior and Insular Affairs, includes a provision to permit the NRC to establish a Citizens Advisory Panel on Three Mile Island which is not subject to the provisions of the Federal Advisory Committee Act. On May 22, 1980, in testimony before that comittee, I committed to proceed with the establish-ment of such a panel in advance of the passage of the Authorization Bill.
The Advisory Panel has now been chartered and formed.
On October 23, 1980, the Commission announced the appointment of the panel.
The membership is balanced as contemplated in the amendment to the Authorization Bill -- three members of the panel recomended by Governor Thornburgh repre ent the Commonwealth of Pennsylvania, three represent local governments in the Three Mile Island area, three represent the scientific community, and three live in the area of the Three Mile Island facility. The chairman of the panel will be Mr. John E. Minnich, Chairman of the Dauphin County Commission.
The names and addresses of the members of the panel are enclosed with this letter.
Since NRC's FY 1981 Authorization Bill has not yet been approved by Congress, the provisions of the Federal Advisory Comittee Act will apply to the panel.
The TMI Program Office staff will be available to brief the panel on the Programmatic Environmental Impact Statement for TMI-2 decontamination (PEIS).
In addition, the Advisory Committee on Reactor Safeguards (ACRS) will provide the panel with technical assistance as may be necessary relating to the decontamination of TMI-2. The Commission intends to call for meetings with the panel at least twice each year.
Additional meetings may be called if two-thirds of the panel members agree and if the Commission and the public are notified.
The panel members will serve without pay. However, while away from their homes or regular places of business in the performance of services for the panel, members of the panel will be allowed travel expenses, including per diem in lieu of subsistence, in the same manner as persons employed intermit-tently in government service are allowed expenses under Section 5703 of Title 5 of the United States Code.

The Honorable Manuel Lujan, Jr. If I can be of any further assistance in th,is matter, please let me know.
Sincerely, s/;
John F.

Dear Mr. Chairman:
"=
On Wednesday, April 30, the House Committee on Interior
" " ~
and Insular Affairs acted unanimously to amend the NRC authorization for FY1981 to establish a Citizens Advisory Panel for the purpose of consulting and advising the NRC h6=
on the decontamination and decommissioning of the Three Mile Island Unit 2 reactor.
- .pg As you know, the idea of the Citizens P nel was first ggg proposed in the report of the Special Task Force of the U55 Three Mile Island Cleanup, which was completed on February 2ff,},3 28 of this year.
The report concluded that "without local public understanding and acceptance of the cleanup opera-tion at TMI-2, an orderly and expeditious cleanup will be y
difficult, if not impossible, to accomplish."
~
The Task Force further recommended that the NRC
[
.4.
"... establish formal means to obtain input from
!=Ei the public on the overall cleanup plan and the gg
==
individual steps to be taken before they are made final and are implemented.
Thi could take the 51 form of a citizens advisory grcm ;> to contribute hE to development of the prograr=.atic statement as has been recommended at several scoping meetings."
We fully expect that the final version of the legislation will contain a comparable provision.
In view of the fact that the cleanup operation is proceeding, we urge you to begin the necessary preparations so that the Panel can be
~--
established as soon as possible.
The NRC already has the Z
authority to establish advisory panels.
As a first step, i--
the NRC should announce its intention to establish the Panel
+-+
and the process by which Panel members will be selected.
The Committee will provide clarification and guidelines in the legislative report to accompany the bill as approved
'~~"g; by the Committee.
In the meantime, close cooperation b.
