Dear Congressman Kostmayer:
The NRC AJthorization Bill for FY 1981, reported by the House Committee on Interior and Insular Affairs, includes a provision to permit the NRC to establish a Citizens Advisory Panel on Three Milc Island which is not subject to the provisions of the Federal Advisory Committee Act. On May 22, 1980, in testimony before that committee I committed to proceed with the establish-ment of such a panel in advance of the passage of the Authorization Bill.
The Advisory Panel has now been chartered and formed.
On October 23, 1980, the Commission announced the appointment of tne panel.
The membership is balanced as contemplated in the amendment to the Authorization Bill -- three members of the panel recommended by Governor Thornburgh represent the Commonwealth of Pennsylvania, three represent local governments in the Three Mile Island area, three represent the scientific community, and three live in the area of the Three Mile Island facility.
The chairman of the panel will be Mr. Jonn E. Minnich, Chairman of the Dauphin County Commission.
The names and addresses of the members of the panel are enclosed with this letter.
Since NRC's FY 1981 Authorization Bill has not yet been approved by Congress, the provisions of the Federal Advisory Committee Act will apply to the panel.
The TMI Program Office staff will be available to brief the panel on the Programmatic Environmental Impact Statement for TMI-2 decontamination (PEIS).
In addition, the Advisory Committee on Reactor Safeguards (ACRS) will provide the panel with technical assistance as may be necessary relating to the decontamination of TMI-2. The Commission intends to call for meetings with the panel at least twice each year. Additional meetings may be called if two-thirds of the panel members agree and if the Commission and the public are notified.
The panel members will serve without pay. However, while away from their homes or regular places of business in the performance of services for the panel, members of the panel will be allowed travel expenses, including per diem in lieu of subsistence, in the same manner as persons employed intermit-tently in government service are allowed expenses under Section 5703 of Title 5 of the United States Code.
