j This refers to the inspection conducted by Mr. C. Stearns of this office on December 28, 1978, of activities authorized by NRC License No. SNM-1504 and to the discussions of our findings held by Mr. Stearns with yourself and Dr. Krauthamer at the conclusion of the inspection.
The inspection was an examination of activities conducted under your license as they relate to radiation safety and to compliance with the Commission's rules and regulations and the conditions of your license.
The inspection consisted of selective examinations of procedures and representative records, interviews with personnel, measurements made by the inspector, and observations by the inspector.
i Our inspector also verified the steps you have taken to correct the item i
of noncompliance brought to your attention in a letter dated October 5, 1977. This item has not been completely corrected.
I Based on the results of this inspection, it appears that one of your j
activities was not conducted in full compliance with NRC requirements, j
as set forth in the Notice of Violation, enclosed herewith as Appendix i
A.
This item of noncompliance has been categorized into the levels as described in our correspondence to you dated December 31, 1974.
This notice is sent to you pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations.
Section 2.201 requires you to submit to this office, within twenty (20) i days of your receipt of this notice, a written statement or explanation in reply including:
(1) corrective steps which have been taken by you and the results achieved; (2) corrective steps which will be taken to avoid further items of noncompliance; and (3) the date when full compliance will be achieved.

Ja" 3 5 ty3 The item shown in the Notice of Violation enclosed with this letter has been identified previously during the inspection of your licensed activities conducted on September 12, 1977 and was documented in the enclosure to our letter dated October 5,1977.
Your letter to this office dated October 27, 1977 scated that a separate file would be established for follow-up of patients implanted with nuclear pacemakers, and an audit i
form would be placed in each file to assure that all records were maintained.
From our December 28, 1978 inspection it appears that your corrective actions were ineffective in that this item has not been completely corrected.
Recurrent and uncorrected items of noncompliance are given additional weight in the selection of appropriate enforcement action.
l Therefore, in your response to this letter you should give particular attention to those actions you plan to take to ensure that items of i
noncompliance will be completely corrected and will not recur.
l In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and your reply will be placed in the Public Document Room.
