APPENDIX A NOTICE OF VIOLATION Maine Yankee Atomic Power Company Docket No. 50-309 Based on the results of the NRC inspection conducted on March 15, 20-23, and 27, 1979, it appears that some of your activities were not conducted in full compliance with the conditions of your NRC Facility License No.
DPR-36, as indicated below. These items are infractions.
A.
Technical Specification 3.17.A.3 states, in part, "The rate of release of radioactive materials in gaseous waste from the plant
... shall be controlled such that the maximum release rate averaged over any one hour period shall not exceed..
31, 000 cubic meters /second."
Contrary to the above, samples of gaseous radioactivity being released from the Primary Vent Stack between 1:00 p.m. and 2:45 p.m. on March 15, 1979, indicate a release rate of 78,604 cubic meters /second.
B.
Technical Specification 5.8.1 states, in part, " Written procedures shall be established, implemented, and maintained covering... the applicable procedures recommended in Appendix A of Regulatory Guide
- 1. 33... " Regulatory Guide 1.33 lists, in part, "3.0 Auxiliary or Reactor Building Heating and Ventilation", Plant Procedure 1-12-3,
" Control Area Ventilation", requires in paragraph 2.6 that, " Spray Building ventilation exhaust be directed through the filters whenever airborne cctivity exceeds 5 E-10 mci /cc..."
Contrary to the above, based on air samples taken in the Spray Building between 1:00 p.m. on March 15, 1979, and 2:40 a.m. on March 16, 1979, airborne activity was as high as 2.8 E-5 mci /cc and a review of the Control Room Log indicated that the ventilation exhaust filters were bypassed until 2:40 a.m. on March 16, 1979.
