Appendix A NOTICE OF VIOLATION Atomic Disposal Company, Inc.
License No. 12-11286-01 This refers to the inspection conducted by a representative of the Region III (Chicago) office of activities authorized by NRC License No. 12-11286-01.
Based on the inspection conducted on November 5, 1979, it appears that one of your activities was in noncompliance with NRC requirements, as noted below. This item is an infraction.
License Condition No. 8 of Byproduct Material License No. 12-11286-01 specifies that the licensee shall not possess any package containing waste byproduct, source, and special nuclear material for a period of more than six months from the date of receipt of the package.
Contrary to the above, on November 5,1979, the licensee possessed packages (at least 20 barrels) containing waste byproduct material received on April 23, 1979. This is a period more than six months from the date of receipt of the package.
This is an infraction.
(Civil Penalty $500).
This Notice of Violation is sent to the Atomic Disposal Company, Inc. pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations.
Atomic Disposal Company, Inc. is hereby requireu to subnit to this office, within twenty (20) days of its receipt of tnis notice, a written statement or explanation in reply, including for each item of nonconpliance, (1) admission or denial of the alleged items of noncompliance; (2) the reasons for the item: of noncompliance if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further noncompliance; and (5) the date when full compliance will be achieved.
