Mr. James P. Bell President Post Office Box 35 Tinley Park, IL 60477 Gentlecen:
An inspection conducted on November 5,1979, showed that Atomic Disposal Cortpany, Inc. was in possession of radioactive waste for a period in excess of the six month limit in the license.
A previous inspection, conducted on June 20,1979, disclosed a similar condition.
In response to the Notice of Violation issued July 20, 1979, concerning the excessive storage time, the Cormany cor:mitted to a new method of inventory control.
The corrective action taken following the July 20, 1979 Notice of Violation was not adequate to achieve lasting cortpliance.
k'e are concerned about your failure to meet the commitments made in response to the July 20 Notice of Violation. Accordingly, Mr. Gen Roy, Deputy Director, Dr. Carl J. Paperiello, Chief, Materials Radiological Protection Section and Mr. C. Thor Oberg, Radiation Specialist, all of our Region III Office, met with you and other r. embers of your staf f on December 5,1979, at your facility.
The item of noncompliance set forth in Appendix A to this letter and proposed corrective action were discussed.
The options available to the NRC were also p resented.
It is cur view that efforts you made to prevent recurrence of this item were inadequate.
Consequently, we propose to impose a civil penalty in the amount of Five Hundred Dollars (S500) for the alleged item of noncompliance against License No. 12-11285-01, as set forth in Appendix A.
Appendix B of this letter is the Notice of Proposed Imposition of Civil Penalties.
You are required to respond to the Notice of Violation and in preparing your response you should follow the instructions in Appendix A.
Your storage system is such that it is impossible to conduct a physical inventory of the stored barrels.
The depth and height of storage are such that information such as lot number and even the physical condition of barrels at the center of storage piles cannot be observed.
In your response please also describe the measures you intend to take to correct the storage conditions, including the system for conducting accurate physical inventories.

Your written reply to the Notice of Violation and the findings of our continuing inspections of your activities will be considered in determining whether further enforcement action, such as additional civil penalties or orders to suspend, rnodify or revoke the license, may be required to assure further compliance.
In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and the enclosures will be placed in the NRC's Public Document Room.
