This refers to your letter dated December 19, 1978, in response to our
letter dated November 24, 1978.
Your letter states that, because of unique circumstances related to the
dates by which compliance with various sections of 10 CFR 73.55 is or
will be required, Maine Yankee believes that no actual item of non-
compliance occurred.
Your letter also states that Maine Yankee intends
to supplement the response to the Notice of Violation at a future time
with a detailed analysis of these unique circumstances.
We have not received any supplemental response from you to support your
contention that the item of noncompliance, as stated in the Notice of
Violation enclosed with our letter of 1ovember 24, 1978, did not occur.

The above comments regarding the search program described in your letter
apply to both the Security Plan submitted on June 27, 1978 and the Maine
Yankee Security Plan, submitted to the NRC by letter dated January 29, 1979
and accepted by the NRC by letter dated February 23, 1979.
The corrective
and preventive actions documented in your letter of December 19, 1978
will be examined during a subsequent inspection of your licensed program.
In accordance with Section 2.790(d) of the NRC's " Rules of Practice,"
Part 2, Title 10, Code of Federal Regulations, documentation of findings
of your control and accounting procedures for safeguarding special nuclear
materials and your facility security procedures are exempt from disclosure;
therefore, the referenced letter and Paragraphs 4, 6, 7 and 8 of this
letter will not be placed in the Public Document Room.
