It is agreed that:

I.

The first sentence of the definition of nuclear facility is amended to read:

" nuclear f acility" means "the facility" as defined in any Nuclear Energy Liability Policy (Facility Form) issued by Mutual Atenic Energy Liability Underwriters or by !!uclear Energy Liability Insurance Association; II.

The definition of "indenified nuclear f acility" is replaced by the following:

"inde.nified nuclear f acility" neans (1) "the facility" as defined in any nuclear Energy Liability Policy (Facility Forn) issued by Mutual Atonic Energy Liability Underwriters or by Nuclear Energy Liability Insurance Associatien, or (2) any other nuclear facility, if financial protection is required pursuant to the Atonic Energy Act of 195h, or any law amendatory thereof, with respect to any activities er operations conducted thereat; III.

Cendition b is replaced by the folloving:

LIMITATION OF LIABILITY: C0Ki40U OCCURREECE Any occurrence or series of occur-rcnces resulting in bodily injury cr property danage arising cut of the radio-ac tiv e, toxic, explosive or other hazardous properties of (a) nuclear natcrial discharged or dispersed fron the facility over a period of days, wecks, months or longer and also arising out of such properties of othcr nuclear naterial so discharged or dispersed from one or more other nuclear facilities insured under any Nuclear Energy Liability Pol-icy (Facility Fern) issued by Mutual Atomic Energy Liability Underwriters, or (b) source material, special nuclear naterial, spent fuel or waste in the course of transportation for which insurance is afforded under this policy and also ariring out of such properties of other source material, special nuclear material, spent fuel or waste in the course of transpcrtation for

'With respect to such bodily injury and property damage (1) the. total accregate liability of the nembers of Mutual Atonic Energy Liability Underwriters under all Nuclear Energy Liability Policies (Facility Form), including this policy, applicable to such cornon occurrence shall be the sum of the limits of liability of all such policies, the limit of liability of each such policy being as determined by Condition 3 thereof, but in no event shall such total aCCreCate liability of such membcrs exceed 013,$00,033; (2) the total liability of the conpanics under this policy shall not exceed that proportion of the total aggre-gate liability of the nembers of Mutual Atomic Energy Liability Under-writers, as stated in clause (1) above, which (a) the limit of. liability of this policy, as determined by Condition 3, bears to (b) the sum of the limits of liability of all such policies issued by such members, the limit of liability of each such policy being as determined by Con-ditior 3 thereof.

Tne provisions of this condition shall not operate to increase the limit of the companies' liability under this policy.

IV.

The secor.d paragraph of Condition 12 "Other Insurance" is amended to read:

"If the insured has other valid and collectible insurance (other than such concurrent insurance or any other nuclear energy liability insurance issued by Mutual Atomic Energy Liability Underwriters or Nuclear Energy Liability Insurance Association to any percon or organioation) applicable to loss or expense covered by this policy, the insurance afforded by this policy shall be excess insurance over such other insurance; provided, with respect to any persen who is not employed at and in cornection with the facility, such insurance as is afforded by this policy for bodily injury to an emplo:/ce of the insured arising out nf and in the course of his employment shall be pri-nary insurara.c inder such other insurance."
