APPENDIX A NOTICE OF VIOLATION Texas Instruments, Inc.

Docket No. 70-33 Based on the results of an NRC inspection conducted on December 6-8, 1978, it appears that certain of your. tivities were not conducted in full compliance with NRC regulations and the conditions of your license as indicated below.

All items are Infractions.

A.

Section 4.4.3 of the Health and Safety Manual, incorporated by Condition No. 8 of Special Nuclear Material License No. SNM-23, states, "All persons shall be issued film badges whenever they enter the Fuel Manufacturing Area."

Contrary to the above, the NRC inspector was not issued a film badge upon entering the Fuel Manufacturing Area on two separate occassions during this inspection.

The inspector was not issued a film badge on December 6,1978 and December 7,1978.

B.

Condition No. 21 of Amendment No. 7 to Special Nuclear Material License No. SNM-23, states, " Supervision shall assure that approved-operating procedures, including the controls associated with radio-logical... safety, are followed and are available on the floor for each operation."

Contrary to the above, on December 7, 1978, approved operating procedures, including the controls associated with radiological...

safety, were not available at the work locations for the Compactor and the Boil Down Unit located in the Furnace Room of the Fuel Manufacturing Area.

C.

10 CFR 20.201(b), " Surveys," requires that surveys be conducted as may be necessary to comply with the regulations contained in each section of Part 20. A " survey," as defined in Paragraph 20.201(a),

means "an evaluation of the radiation hazards incident to production, use, release, disposal, or presence of radioactive materials or other sources of radiation under a specific set of conditions.

When appropriate, such evaluation includes a physical survey of the location of materials and equipment, and measurements of levels of radiation or concentrations of radioactive materials present."

Contrary to the above, the licensee failed to make such surveys as may be necessary to assure compliance with 10 CFR 20.103, " Exposure of individuals to concentrations of radioactive materials in restricted areas." Specifically, surveys to determine the airborne concentrations of radioactive materials were not performed in the vicinity of the Compactor located in the Furnace Room of the Fuel Manufacturing Area as radioactive waste compaction operations were performed approximately weekly during 1978.

D.

Sectinn 4.3.3 of the Health and Safety Manual, incorporated by Condition No. 8 of the Special Nuclear Material License No. SNM-23, states, " External radiation surveys for alpha radiation shall be made in the Fuel Manufacturing Area.

Instruments to be used for external radiation surveys shall be an

'pha survey meter."

Contrary to this requirement, s.~;h surveys as were made to assure compliance with Section 4.3.3 ware inadequate in that the licensee only surveyed the walls of tSe Fuel Manufacturing Area.

The licensee did not survey the floors ar i equipment in the area during the calendar year 1978.
