Docket No. 50-334 Duquesne Light Company ATTN: Mr. C. N. Dunn Vice President Operations Division 435 Sixth Avenue Pittsburgh, Pennsylvania 15219 Gentlemen:

The NRC has amended its regulations as part of its implementation of the Resident Inspection Program.

The amended regulations implement existing NRC authority to require that licensees provide (1) onsite, rent-free, exclusive use office space and (2) immediate facility access to Comission inspection personnel.

I enclose a copy of the final rule that was effective September 17.

You have been providing office space at your Beaver Valley facility and I want to thank you for your cooperation.

The Comission recently approved an expansion of the Resident Inspector Pmgram which will increase the number of resident inspectors at this facility to two on or about January 30, 1980.

An NRC part-time secretary will be provided to the resident office also. Therefore, I suggest you plan to expand or othentise make available additional' office space.

Please infonn the NRC Region I Director, Boyce H. Grier, within 14 days of your plans to accommodate this NRC staff at your facility.

Should you have any questions or concerns about this new rule or about the increased number of the resident inspector staff, please contact the NRC Regional Director.

Sincerely, Victor S

, Jr.

SUPPLEMENTARY INFORMATiote On May 9.1978, the Nuclear Regulatory Commission publishedin the Federal Register (43 FR 19860) a proposed amendment to its regulations.10 CFR 50 Licensing ofProduction and Utilization Facilities and Part 70 SpecialNuclear Material, which would implement authority of Section IS1(o) of the Atorbic Energy Act of1954, as amended, and of the Energy Reorganization Act of1974.

' site resident inspection portion of its i revised inspection program..-

Interested persons were invited to submit written comments for -

consideration in connection with the proposed amendment by June 23.1978.

The comments which were received addressed three principal concerns: '

licensees should not be forced to provide rent-free space; the proposed space requirement was excessive and arbitrary; and inspector access provisions should be the same as for a NUCLEAR REGULATORY reSular plant employee.

In mid-1978. the Commission initiated
