Dear Mr. Pilant:
In a letter dated October 23, 1979, Nebraska Public Power District indicated that an interim commitment for demonstrating conformance with 40 CFR Part 190 for the Cooper Nuclear Station can be satisifed by the continued operation of the Cooper Nuclear Station in accordance with the present Technical Specifications.
The present Technical Specifications of the Cooper Nuclear Statica for radiological liquid and airborne effluents are based on the limits of 10 CFR Part 20. We detennined that conformance with the specifications that are based on the limits of 10 CFR Part 20 would not be an acceptable method for demonstrating compliance with 40 CFR Part 190. Please provide, within 30 days of receipt of this letter, a commitment to the provision of Specification 3.11.4 of NUREG-0473, Radiological Effluent Technical Specifications for BWRs, Revision 2, or other equivalent methods, which include all pathways and direct radiation, for demonstrating confonnance with 40 CFR Part 190.
