Appendix A NOTICE OF VIOLATION Toledo Edison Company Docket No. 50-346 s

Based on the inspection conducted on August 13-17, 27-31, September 10-14 and 24-28, 1979, it appears that certain of your activities were in noncom-pliance with NRC requirements, as noted below. These items are Infractions.

1.

Technical Specification 3.3.2.1 requires, in part, that the emergency diesel generator Sequence Logic Channels be operable when the reactor coolant system is above 200 F.

The operability of the Sequence Logic Channels depends upon the operability of the Essential Bus Feeder Breaker Trip (90%) undervoltage sensing relays described in Technical Specification Table 3.3-4.

Contrary to the above, on November 4, 1978, during the performance of the natural circulation test and on several other occasions prior to December 1978, certain Sequence Logic Channels were rendered inoper-able for short periods of time when the reactor coolant system average temperature was above 200 F.

This was accomplished by disabling the 90% undervoltage sensing relays when starting a reactor coolant or circulating water pump.

No response to this item is required since corrective action has been taken to avoid disabling the undervoltage sensing relays.

2.

Technical Specification 6.5.1.6.e requires the Station Review Board to investigate all violations of Technical Specifications including preparation and forwardir.g reports covering evaluation and recommen-dations to prevent recurrence to the Vice President - Energy Supply and to the Chairman of the Company Nuclear Review Board.

Contrary to the above, the Station Review Board did not investigate the violations of Technical Specification and prepare a report for the items contained in IE Inspection Report No. 50-346/79-04 dated March 28, 1979.
