Puroose:

Commission review of proposed issuance of export license to Nissho-Iwai American Corporation for the transfer of 6,001 kilograms of heavy water to Japan.

Review Exoiry Dates:

60-day period expired January 15, 1979.

120-day period expires March 13, 1979.

Discussion:

In August 1978, Nissho-Iwai American Corporation filed an application to export 6,001 kilograms of heavy water to Japan. The material will be shipped to Power Reactor and Nuclear Fuel Development Corporation for use as a moderator in the Fugen prototype advanced thermal reactor in Tsuruga, Japan.

The Executive Branch, by letter dated November 15, 1978 (Appendix B), concludes that the requirements of the Atomic Energy Act, as amended, and of P.L.95-242 have been met and that the proposed export would not be inimical to the common defense and security of the United States.

The staff agrees that Japan meets the criteria for this export of heavy water.

The staff notes that IAEA safeguards, including material control and accounting procedures, will not be applied

. directly to the heavy water but instead to the reactor in which the facility will be used and, of course, to the nuclear fuel used in the facility and to any special nuclear material produced through the use of the heavy water.

Section 309 of the NNPA requires that IAEA safeguards be applied "with respect to each exported component, item or substance."

For reactor component exports, it is clear that the requirements of the NNPA are met when it is confirmed that IAEA safeguards will be applied to the facility in which the components are to be installed, since there are no programs for the direct application of safeguards to components them-selves. Heavy water exports are subject to the same requirements as components under the NNPA, and there-fore the staff has concluded that, since the Fugen reactor is subject to safeguards, the proposed export meets the NNPA safeguards criterion. As a related matter, the staff has not yet received information from the Executive Branch concerning the status of the Facility Attachment for the Fugen reactor. We are in the process of obtaining confirmation from the Executive Branch that the recent entering into force of the Subsidiary Arrangements of the Japan /IAEA Safeguards Agreement means that all negotiated Facility Attachments for Japan, including Fugen, are in effect.

The following documents are forwarded for Commission review of the subject application:

(1) Executive Branch views of November 15, 1978 recommending issuance of the license (Appendix A); (2) application of August 24,1978 (Appendix B); and (3) copy of proposed license (Appendix C).

Recommendation:

That the proposed license be issued to Nissho-Iwai American Corporation.

Coordination:

ELD has no legal objection.

NMSS concurs.

Extent to Which Export Criteria Are Met A.

Section 109 Criteria As provided in Section 109 of the Atomic Energy Act, as amended, the following criteria govern exports for peaceful nuclear uses from the United States of components specially designed and prepared for use in a nuclear facility.

Criterion (1)

"IAEA safeguards as required by Article III(2) of the Treaty will be applied with respect to such com-ponent substance or item;"

Japan is.a Party tc the Treaty on the Non-Prolifer-ation of Nuclear Weapons and deposited its instrument of ratification on June 8, 1976.

Tnis Japan /IAEA Safeguards Agreement pursuant to the NPT entered into force on December 2, 1977.

Therefore, it is the Executive Branch view that criterion (1) is met.

SHEA NUCLEAR REGULATORY COMMISSION Enclosed is an Executive Branch analysis covering a license application for the export of heavy water to Japan.

In accordance with P.L.95-242, the analysis explicitly addresses how the requirements of Section 109 b.

of the Atomic Energy Act, as amended, are met.

The Executive Branch, on the basis of its review of this application, has concluded that the requirements of the Atomic Energy Act, as amended, and P.L.95-242 have been met and that the proposed export would not be inimical to the common defense and security of the United States.

Moreover, Japan has adhered to the provisions of its Agree-ment for Cooperation with the United ~ States.

Therefore, the Executive Branch. recommends issuance of the requested export license.

NIAC-78-005 Purpose of Export This heavy water will be used as a moderator in the FUGEN prototype advanced thermal reactor located at Tsuruga, Japan.

The FUGEN is a boiling light water cooled and heavy water moderated reactor with a 165 megawatt electric output.

The FUGEN is owned and will be operated by the Power Reactor and Nuclear' Fuel Development Corpora-tion and is expected to become operational in March 1979.

Shipment of the heavy water will be made as soon as possible after issuance of the required export license.

Criterion (2)

No such component, substance or item will be used for any nuclear explosive device or for research on or development of any nuclear explosive device;"

As a party to the NFT, the Government of Japan is committed not to develop or use nuclear explosive de-vices for any purpose.

Therefore, it is the Executive Branch view that criterion (2) is met.

Criterion (3)

"No such component, substance, or item will be re-transferred to the jurisdiction of any other nation or group of nations unless the prior consent of the United States is obtained for such retransfer;"

The Government of Japan by letter from their Embassy in Washington dated October 5, 1978, provided a generic assurance that U.S.-supplied components and materials would not be retransferred beyond the jurisdiction of Japan without prior U.S.

consent.

In Executive Branch analysis of the Japanese reply was transmitted to the Commission by letter dated October 20, 1978.

Therefore, it is the Executive BrancP view that criterion (3) is met.

Inimicality Judcment Based on review of the proposed export, it is the judgment of the Executive Branch that the proposed ex-port will not be inimical to the common defense and security, and that the license should be issued.

Enclosed is a copy of a letter dated October 5, 1978 from the Embassy of Japan in answer to our letter of September 19, requesting confirmation that nuclear com-ponents specially designed and prepared for use in a nu-clear facility, deuterium (including heavy water) and nu-clear grade graphite, exported from the U.S.

to Japan, would not be retransferred beyond the jurisdiction of Japan without the prior approval of the United States.

In its response, the Government of Japan confirms in accordance with Article 10 A (3) of the U.S.-Japan Agree-ment for Cooperation, that no material including equipment and devices will be transferred beyond the jurisdiction of Japan without the prior consent of the United States.

We believe it is clear that the Government of Japan considers their October 5 letter a confirmation of the undertaking saught in the U.S.

request of September 19, that Japan will treat the components, items and substances referred to in the U.S.

letter as constituting " material, including equipment and devices" transferred pursuant to the Agreement and thus subject to U.S.

retransfers ap-proval.

However, to remove any possibility of ambiguity in this regard, we have advised the Government of Japan that it is our understanding these camponents, items and substances will be exported to Japan pursuant to our agree-ment for cooperation.

It is also the view of the Executive Erancb that the first two criteria of Section 109 b.

On the basis of the above, it is the judgment of the Executive Branch that the issuance of export licenses for the export of these components, items and substances to Japan will not be inimical to the common defense and secur-ity.

Therefore, it is the view of the Executive Branch that, in the absence of a material change in circumstances, all statutory requirements are satisfied for export licens-ing of. nuclear components, substances and items to Japan.
