LICENSING SCHEDULE - SOUTH TEXAS PROJECT, UNITS 1 AND 2 The schedule for the radiological safety review of the South Texas Project, Units 1 and 2, was transmitted to you by letter, dated November 22, 1978.
We discussed this schedule with Mr. W. M. Menger of your staff on December 5, 1978.
In a letter, dated December 15, 1978, you commented that the above referenced schedule includes overly conservative times for (1) the preparation of NRC questions, (2) your responses to these questions, and (3) SER and SER supplement issuance.
You also indicated that the schedule leaves insufficient margin to accommodate a hearing without impacting the fuel load date. As a result, you requested us to revise our schedule to reflect a preferred schedule transmitted with your December 15, 1978 letter. Our responses to your comments and request are presented below.
Our schedule for South Texas was developed on the basis of current staff resources and work loads, and took into consideration the projected fuel load date, a potential hearing, and other case work priorities. The schedule is considered to be realistic and not overly conservative, actually reflectin; a projected decision date about four months before your current projected fuel load date of November 1, 1981 for Unit 1.
The schedule you propose is unrealistic for the following reasons. We could not meet your proposed date of January 4,1979 for providing you with our first round questions. Also, the schedule you propose does not provide any time to evaluate your responses to first round questions before establishing staff positions.
In addition, the time spans in your proposed schedule for issuance of the SER and SER supplement cannot be met without affecting other case work priorities.

Based on the above considerations, we cannot grant your request to revise the South Texas review schedule at this time. We suggest that if, af ter completion of the first round question phase (targeted for October 1979),
you find that the review schedule is not compatible with the then projected fuel load date for Unit 1 of South Texas, you can resubmit a request for schedule improvement for our consideration at that time. By then, we would be in a better position to reassess the projected fuel load date based on the pace and status of construction. We would also be in a better position to determine the extent of effort for the hearing process, if required.
In this regard, the Atomic Safety and Licensing Board has established a date of January 11, 1979 for a special prehearing conference in Houston, Texas to discuss the admissability of th,i filed petitions.
