Dear Mr. Brunner:

This correspondence is in response to the Notice of Violation as described in the report of Inspection 50-213/78-27 that was conducted during November 13-16, 1978.

Infraction Technical Specification 6.13.1, in reference to high radiation areas in which the intensity of radiation is greater than 1000 mrem /hr, states, in part, "...In addition, locked doors shall be provided to prevent unauthorized entry into such areas...."

o' Infraction Continued Contrary to the above, the entrances to the Residual Heat Removal Pit (RHR) and the charging pump and metering pump cubicles in the Primary Auxiliary Building, where radiation levels are in excess of 1000 mrem /hr, as detennined by inspection on November 5,1978, are controlled by pad-locked gates which are insufficiently high to prevent unauthorized entry.

Response

We have conducted a thorough review of Technical Specification 6.13.1 and Code of Federal Regulations Title 10, Part 20.203(c) and conclude that neither document addresses nor defines the height requirements for the barricade or door at the entrance to High Radiation Areas.

Since the Technical Specifications do not address the height requirement we hereby request that the alleged violation be rescinded.
