Dear Mr. Carlson:

Re: Nine Mile Point Unit 2 Docket No. 50-410 On December 4, 1979, Niagara Mohawk Power Corporation notified Mr. A. C.

Cerne of your staff by telephone of a potential deficiency at the Nine Mile Point Unit 2 construction site. This condition ccncerned the possible future movement of the Radwaste Building geclogic feature.

Our January 7,1980 letter proviced the results of the preliminary analysis of the Radwaste Euilding geologic feature. This analysis indicated that there is insufficient information available to determine if potential rock adjustments in the vicinity of plant structures is reportable in accordance with the strict interpretation of 10CFR50.55(e).

However, to assure coripliarce with your interpretation of the regulation, Niagara Mohawk nereby notifies tne Nuclear Regulatory Commission that the potential future rock adjustments near plant structures is considered as reportable in accordance with 10CFR50.55(e). This includes the potential for both small vertical ano horizontal rock adjustments. The questions of possible movement and the predicted amcunt are being further studied by continuing review, field investigation and geologic monitoring.
