Dear Mr. Fleischaker:
This is in regard to your letter dated January 7,1980, in which you requested, pursuant to the Freedom of Information Act, additional documents pertaining to the October 19, 1979, meeting on the Diablo Canyon Nuclear Power Plant which was the subject of your earlier F0IA request under F01A-79-464.
In response to your first request, copies of the documents listed in Appendix A are enclosed (total 19 pages).
Copies of these documents are also being placed in the NRC Public Document Room (PDR), lociad ac 1717 H Street, N.W., Washington, DC.
Documents 2, 3, 4 and 5 of Appendix A were concurred in by [r. Joseph M.
Hendrie, document 7 af Appendix A was sied by Dr. Hendrie, and documents 1 and 6 of Appendix A were addressed to Dr. Hendrie.
In response to your second request, we rcfer you again to t1e General Counsel's letter to you dated Januarj 3,1980, (copy enclosed), whereir Mr. Bickwit declined to provide you with a copy of his handaritten notes which he produced for his own use at the October 19, 1979 neeting. These notes are not " agency records" within the meaning of the Freedom of Information Act, and they are not subject to your F0IA regt est of January 7,1980.
These notes were not circulated to nor used by anyone other than Mr. Bickwit, are not required to be retained by NRC regulatio. s or procedures, and may be discarded or retained at the author's sole discretion (see Porter County Chapter of Isaak Walton Leagle of America
- v. Atomic Enerqv Conmission, 380 F. Supp. 630 (N.D. Ind. H74)).
With respect to your third request, Mr. Edson G. Case has informed us that he did not take any notes of his telephone conversation with 1950 309 1
