MOTION FOR CONTINUANCE OF. ORAL ARGUMENT Intervenor, San Luis Obispo Mothers For Peace, hereby petitions for a.continuance of the oral argument on the security plan issues set for January 23, 1980 in San Francisco.
The oral argument was set by an Order of January 2, 1980, which was received by Intervenor on January 8, 1980.
Intervenor's attorney, Paul C. Valentine, is one of counsel of record in Pacific Gas
& Electric Co., et al, Southern California Edison, et al. vs. State Ene cv Resources Conservat'on and Develo ment Co-mission, Civil No. S-78-527-MLR in tne United States Distr't Court, Eastern Dis rict of Cali=ornia.
The trial is calendared to begin January 14, 1980 in Sacramento.
The case has been prepared on an evpedited basis.

unresolved procedural issues resulted in the filing of a Petition for Writ of Mandate and, for Stay of Trial on January 3 in United States Court of Appeal, Ninth Circuit, which is still pending.
The estimated time for trial is 4-5 days, but the intensity o the pretrial preparation makes actual time for trial extremely uncertain.
In counsel's opinion it is unlikely that case will be concluded by January 23.

These groups are

merely standing on the sidelines, but are actively contribut-I

can as non-intervenors.
The mass of citizen correspondence filed in the NRC public document room is, further evidence of the high public interest in this case.

This operating license proceeding is certainly one of the most controversial before the Commission.
Local in-terest in the case is high.
Closeting the oral argument on the seismic issues in a building in Bethesda, Maryland effectively excludes from the hearing the people whose health and.safety is directly affected by the operation of I
the Diablo Canyon Nuclear Power Plant.
No party is unduly inconvenienced by holding the oral argument in California.

scheduled hearing in San Prancisco on security issues relatin'g to the proposed Diablo Canyon Nuclear Po~er Plant.
This citizen's group represents a-responsible and broad-based community concern about the safety and risks of this proposed facility, and feels strongly that the appeals hearing should be held in this county.
Although it is understood that this appeal procbeding will not include public'articipation, may we assure you this proposed action can only deepen the community's suspicion that your agency and the applicant are engaged in a conscious effort to keep crucial issues of local public health and safety removed from the very people who will carry the burden of'isk.
Such conduct was reproved by the President's Commission on the Accident at Three Mile Island.
The local public has long been without complete information and knowledge on the issues surrounding the applications of PGM for Diablo.

It is my understanding that the Appeal Panel soon will hear'avid
, Fleischaker's oral arguments against the Licensing Board's ruling on Diablo Canyon.
I am further led to believe that on the basis that Mr. Fleischaker's principal residence is in 1'ashington, D.C., that the Appeal Panel has scheduled the oral arguments for hearing at Bethesda, Maryland.
I am most pleased that the Appeal Panel will hear Mr. Fleischaker's arguments.
I am dumbfounded that, with such high local public interest in the outcome, the Appeal Panel would schedule its meeting location for the convenience of the attorney rather than =or that of the clients, i.e., the concerned citizen taxpayers (and ratepayers) of the County.
As an elected representative responsible to som 28,000 constituerts in my District, and 145,000 Countywide, I implore vou to schedule the oral arguments in San Luis Obispo County.
Certainly, an issue with such potentially grave consequences to our popu1ace ouqht. to be heard where ihe people affected could a.tend.
