Dear Mr. Carr:

By letter dated October 26, 1979, I submitted an F0IA request for the following documents:

1.

All contemporaneous notes, any memorandum, or records pertaining to a meeting held on October 19, 1979 on the Diablo Canyon Nuclear Power Plant at which the following were present:

Joseph M. Hendrie, Chairman, NRC; Frederick Mielke, Chairman of the Board, Pacific Gas and Electric Company (PG&E); Bart Shackelford, President, PG&E; Gene Blanc, PG&E employee; Donald Hassell, Legal Assistant to the Chairman of the NRC; Leonard Bickwit, Jr., General Counsel of the NRC.

2.

All contemporaneous notes, any memorandum, or records pertaining to a meeting held on Octcber 19, 1979 on Diablo Canyon Nuclear Power Plant at which Commissioner Richard T. Kennedy and of ficials representing Pacific Gas and Electric Company were present.

3.

All records pertaining to Joseph M, Hendrie's participation in the review of the Diablo Canyon license ap-plication prior to becoming Chairman of the NRC.

John C. Carr, Acting Director January 7,1980 Page Two By letter dated November 23, 1979 and in response to the F01A request, your offices forwarded a copy of John Steven's handwritten notes of the Kennedy meeting.

However, several matters remain to be addressed.

First, my October 26th request covered "all records pertaining to Joseph M. Hendrie's participation in the review of the Diablo Canyon licensing application prior to becoming Chairman of the NRC."

Your response did not address that request.

Second, I requested that you identify material that, in your judgment, is exempt from release and identify the exemptions you believe cover the material.

On January 3, 1980, I received a letter from Leonard Bickwit, General Counsel, NRC indicating that he had personal handwritten no es taken in connection with the October 19th meeting.

These notes were not identified in your November 23rd response.

Since, the NRC will apparently not make these notes available, please identify which exemption you believe ccvers them.

/:1so, because these important notes were not uncovered by your initial rounds of inquiries, please check to assure that other important documents have not escaped your attention.

Third, on October 19, 1979, Chairman Joseph M. Hendrie spoke by telephone to Edson Case, Office of Nuclear Reactor Regulation about his meeting with the PG&E officials on the Diablo Canyon case.

Commissioner Hendrie has documented this telephone conversation in his memorandum filed with the public documents room.

I am requesting that you check with Mr. Case to determine whether he has any notes of that telephone conversation.

I look forward to your response on these matters.
