Dear Dr. Cassens:

Regarding Violation #1 (both licenses).

Point of Clarification.

It is not correct to state that the nuclear sources had not been tested for leakage since 1970 (for SNM-886) or since 1966 (for 35-In32-01).

It would be correct to state that no proper records of such tests were available at the time of the visitation. The most recent Icakage tests prior to the visit were conducted in the Spring Semester of 1979, although the results were recorded only infomally.

1 Corrective action. A thorough search of departmental records was initiated, but the missing records have not been located. However, it is known that leakage tests have been conducted since 1966 but without specific records we cannot be certain that all of the required tests were conducted on schedule.

The confusicn arises because the person responsible for the testing, Mr. Harvey Ogden, lef t the University under fire in August, 1978.

When I became Chaiman of the Department of Physics in August, 1978, I instructed Mr. Don Fit:: gerald, the Campus Radiation Officer, that all leakage tests must be conducted on schedule.

This has been done, although because both of us were new in our respective positions proper records were not kept.

We have now devised an appropriate fom to be used for all tests and designated a special file in which all records will be kept.

We have desig-nated February and August as the months in which leakage tests will be conducted, starting in 1980.

(The two tests conducted in 1979 were on a slightly different schedule.)

Corrective actions to avoid further items of non-compliance.

The Chaiman of the Physics Department, the Campus Radiation Officer, the Physics Associate, and other appmpriate personnel, if any, will annually review the NRC regulations to ascertain which ones are relevant to our situation.

Full compliance. We believe we have complied with the spirit of the regulations IInce the first icakage test in 1979, and possible well before that time.

We believe we are now in full compliance with the letter of the regulation and have been.vince the latest leakage test in October 1979.

Regarding Violation #2 (for both licenses) 1.

Corrective action. The proper fom was posted in the Nuclear Radiation Lab-oratory on October 24, 1979 2

Corrective action to avoid further items of noncompliance.

See item 2 above.

Full compliance.

The required notice was posted in the Nuclear Radiation Laboratory on Octouer 24, 1979.
