SECCND STIPULATICN REGARDING CERTAIN SL"EFOLK COLTl'Y CONTENTICNS I.
Technical and legal representatives of the Applicant, the.NRC Staff and Suffolk County (SC or County) have continued their efforts to facilitate informal discovery by SC, as well as to resolve and/or particularize certain SC cententions.
As a result cf these meetings, the Applicant, Staff and County stipulate that:
A.
The folicwing SC contentions will be pursued no further in this proceeding either because the pertinent County concerns have been resolved or because they will be covered in other SC contentions:
4a (vi), 6 a (iii), 12a (i), 13a(i) and 13a (iv).

SC having agreed to drop contentions 6a(i) and 6a(ii), the Applicant agrees to meet the follcwing conditions:1/

. Reactor coolant system leakage shall be limited to (a) no pressure boundary leakage, (b) 5 gpm UNIDENTIFIED leakage, (c) 25 gpm total leakage averaged over a 24-hour period, and (d) a 2 gym INCREASE in UNIDENTIFIED leakage within ani 4-hour period.
If reactor coolant system leakage is greater than limit (a) above, then the plant shall be in hot shutdown within 12 hours1.388889e-4 days <br />0.00333 hours <br />1.984127e-5 weeks <br />4.566e-6 months <br /> and in cold shutdown within the next 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />.

C.
SC contentions 6b and 17a(ii) (mentioned in the June 5, 1979 Stipulation) have been ecmbined and will be re-st ced in a subsequent stipulation.
D.
SC contentions 4a(vii) and 7a(ii) are combined and restated as a single contention (hereafter designated as SC Contention No. 1), which reads as folicws.3/
The remote shutdcwn system does not have adequate instrumentation or controls to meet 10 CFR 50, Appendix A, Criterion 19.
The instrumentation and 1'/ The NRC Staff views these conditions as applying solely to the Applicant and County.
The Staff reserves the right to inpose additional requirements on operational leakage through the Shoreham technical specifications.
-3/ By agreeing to this or any other contentien, the Applicant and Staff waive any right to argue that the issue has not been adequately particularized, but they do not waive the right to object to the contention's adequacy as a matter of law or cc seek its summary disposition.

controls for the following systems are inadequate to provide for indication of failures in valves and controls with a high frequency of failures:
(1)
Reactor Core Isolation System (valves, motor operators and pump),
(2)
Residual Heat hamoval System (motor and air valve operators), and (3)
Service Water System (motor and air valve operators).
E.
SC contentions 4a(viii) and 4a(xvi) are combined and restated as a single contention (hereafttr designated as SC Contention No. 2), which reads as follows:$!
The onsite emergency generating system does not meet 10 CFR 50, Appendix A, Criterion 17 because of the high probability of system failure due to accumulation of dirt in relays located in the diesel generator recms.
II.
The parties to this stipulation request that the Board accept the agreements set out in part I above.
III.
There will be continuing efforts by the Applicant, Staff and County to resolve and/or ade raately particularize
