AFFIDAVIT OF STUART A. TREBY I, Stuart A. Treby, swear and depose as follows:
1.
I am an Assistant Chief Hearing Counsel in the Office of the Executive Legal Director, Nuclear Regulatory Commission, Washington, DC.
In this capacity, I supervise the work of Hearing Section I, including the work of Henry J. McGurren and Lawrence J. Chandler, attorneys, and Andrenna Smith, secretary, assigned to Hearing Section 1.

On January 10, 1980, Andrenna Smith informed me that Mr. Janes M. Cutchin, V, an employee of the OELD mail and file room section had trought to her office a large manila envelope addressed to Henry J. McGurren-Ms. Smith E
further informed me that Mr. Cutchin had indicated to her that he had opened the envelope before noting the instructions on the back side and F
was inquiring what action should be taken with the contents of the envelope.

I examined the large manila envelope and noted the instructions written on the back side of the envelope that it not be opened until February 5, 1980.
I inquired of Ms. Smith whether she had seen or read the documents contained in the envelope.
She advised me she had been shown two letter-size envelopes and a number of unfolded documents by Mr. Cutchin but that she had not read any of the documents and had no knowledge of their contents.

I inquired if any other attorneys in the section had seen the envelope and and its contents.
She informed me that my deputy, Mr. Lawrence J. Chandler had been present when Mr. Cutchin brought the envelope to her office.
I inquired of Mr. Chandler what knowledge he had of the envelope. He verified that he had been present when Mr. Cutchin brought the envelope to Ms. Smith's office, that he had observed the envelope and the instructions and seal on the back side of the envelope and had been shown that the envelope con-tained at least one letter-size envelope, and a number of unfolded docu-

ments held by Mr. Cutchin.
Mr. Chandler indicated that he had not read any of the documents and had no knowledge of their contents.
Mr. Chandler further indicated that he suggested that Mr. Cutchin speak to me when I returned to the of fice.
I inquired of Mr. Cutchin whether he had read the documents contained in the envelope and he stated he had not.

I enclosed the large manila envelope in another manila envelope, sealed it with tape and wrote on this second envelope the instruction that it not be opened until February 5, 1980. At no time did I remove any of the contents of the large manila envelope and have no knowledge of its contents.

On Mr. McGurren's return to the office on January 11, 1980, I informed him of the events set out above and gave the sealed envelope to him.
I directed that he call Mr. Sinkin and advise him of these events.
