AFFIDAVIT OF JAMES M. CUTCHIN, V I, James M. Cutchin, V, swear and depose as follows that:
1.
I am employed by the Nuclear Regulatory Commission as a mail and file clerk for the Office of the Executive Legal Director.
2.
On January 10, 1980, upon receipt of the afternoon mail I opened a large manila envelope addressed to Henry J. McGurren which was sealed. After
- opening this envelope I found and opened two white letter-size envelopes which were also sealed.
Each of these letter-size envelopes contained two folded documents.

After finding a hand-written message on the back side of the large manila envelope indicating that the envelope was not to be opened until February 5, 1980, I sought out the addressee Mr. McGurren.

On finding that Mr. McGurren was not in his office, I asked his secretary Andrenna Smith, where he could be found.
Ms. Smith indicated that he was on travel.
I then explained to Ms. Smith and Mr. Chandler, another attorney assigned to the South Texas case, that I had opened the large manila envelope addressed to Mr. McGurren.
I directed their attention to the documents contained in the large envelope, but neither Ms. Smith or Mr. Chandler 1871 183 o)~

read any of the documents.
Mr. Chandler suggested that I discuss this matter with Mr. McGurren's supervisor, Mr. Treby.
I then placed the documents in the letter-size envelope and these envelopes in the large manila envelope and give the large envelope to Ms. Smith to give to Mr. Treby since he was not in his office.
5.
I did not at any time read any of the documents that were contained in the two envelopes enclosed in the large manila envelope.
