LICENSEE'S STATEMENT OF MATERIAL FACTS AS TO WHICH THERE IS NO GENUINE ISSUE TO BE HEARD (CEC CONTENTION 5-2)

Pursuant to 10 C.F.R.

S 2.749(a), Licensee states, in support of its motion for summary disposition of California Energy Commission's (" CEC") Contention 5-2 in this proceeding, that there is no genuine issue to be heard with respect to the following material facts:

The function of the controlled filtered venting system proposed by CEC in Contention 5-2 would be to prevent or delay containment failure in the event of an accident in-volving core melt or a lors of coolant accident more severe than a break equivalent in size to the double-ended rupture of the largest pipe of the reactor coolant system. Rancho Seco has a containment and related engi-neered safeguards to control the containment atmosphere following postulated accidents which conform to all applicable requirements 1873 262 A

Rancho Seco does not have a controlled filtered venting system such as that proposed by CEC, and such system is not required for Rancho Seco to achieve conformance with any existing regulatory requirement.

A controlled filtered venting system such as thtt proposed by CEC would include rupture discs in the containment which would rupture at pressures at or below the containment design pressure.
