Inspection 50-322/79-07

This refers to your letter dated September 27, 1979, in response to our

letter dated August 21, 1979.

The corrective and preventive actions with respect to Noncompliances No.

I and III which are documented in your letter will be examined during a

subsequent inspection of your program.

Your " General Comment" with respect to Apparent Noncompliance No. II states,

in part "... Regulatory Guide 1.75...also allcws for alternative methods of

compliance. The basic separation criteria are not waived or changed but

remain a plant design basis. Therefore, no change to the FSAR is required."

During a telephone discussion on October 5, 1979, we were informed by a

member of your staff that an analysis of the safety implications of the

destruction of electrical systems in various zones of the facility is in

progress and will be submitted to the Office of Nuclear Reactor Regulation.

We do not agree that the basic separation criteria are unchanged nor that

there is no change to the FSAR.

Paragraph C.6 of Regulatory Guide 1.75 states,

in part " Analyses performed...should be submitted as part of the Safety Analyses

Report..." Therefore, failure to complete the analysis and submit ".t to the

Office of Nuclear Reactor Regulation is considered to be a failure to promptly

correct a nonconforming condition as required by 10 CFR 50, Appendix B,

Criterion 16.
