APPENDIX A NOTICE OF VIOLATION United Nuclear Corporation Docket No.70-820 Wood River Junction, Rhode Island License No. SNM-777 Based on the results of an NRC inspection conducted on August 27-31, 1979, it appears that certain of your activities were not conducted in full compliance with NRC regulations and conditions of your license No. SNM-777 as indicated below. The first item is an infraction, and the second and third items are deficiencies.

10 CFR 71.54(i), Routine determinations, requires that, " Prior to each use of a package for shipment of licensed material the licensee shall ascertain that the package with its contents satisfies the applicable requirements of Subpart C of this part and of the license, including determinations that:

(1) The package has been loaded and closed in accordance with written procedures."

Contrary to the above, on August 29, 1979, the written procedure for packaging product did not address the closure of the inner containers of the shipping containers.

10 CFR 71.62(a)(10), Records, requires that, "(a) The licensee shall maintain for a period of 2 years after its generation a record of each shipment of each shipment of fissile material or of more than a type A quantity of radioactive material as defined in 571.4(q), in a single package, showing, where applicable:

Results of the determinations required by s71.54."

10 CFR 71.54(c), Routine Determination, requires that prior to each use of a package for shipment of licensed material the licensee shall determine that the closure of the package and any sealing gaskets are present and are free from defects.

Contrary to the above, the licensee's records for packaging of product during January through July 1979 did not include records showing that the closure of the inner container was closed properly with the use of defect

-free gaskets or sealing lute.

Licensee Condition 9 of License No. SNM-77 authorizes use of special nuclear material in accordance with section 300 of the licensee's appli-cation.

Section 305.1.1.2 states, "Borosilicate glass raschig rings shall be Corning Glass 7740 type or equivalent containing a nominal four (4) weight percent natural boron with a range of 11.2 to 13.8 weight 0-percent B2 3 Contrary to the above, the borosilicate glass raschig rings in I-D-24A filtrate tank as of November 22, 1978, did not have a boron content in the range of 11.2 to 13.8 weight percent B2 0*
