Inspection 70-820/79-16 This refers to your letter dated October 24, 1979, in response to our letter dated October 9,1979.

Thank you for informing us of the corrective and preventive actions documented in your letter for item of noncompliance 2 of Appendix A to our letter of October 9,1979.

These actions will be examined during a subsequent inspection of your licensed program.

With regard to item of noncompliance 1 of Appendix A to our letter of October 9,197?, yr a stated that you are currently operating in accordance with your exisung quality assurance program as authorized under 10 CFR 71.51(a), and this program, in your opinion, meets the requirements of 10 CFR 71.54.

During the inspection, our inspector did not inspect your current quality assurance program to assess whether or not your current quality assurance program does, in fact, meet the requirements of 10 CFR 71.54.

In order for our inspector to make this determination, please send us a copy of your existing quality assurance program which you are using as required by 10 CFR 71.51(a).

With regard to item of noncompliance 3 of Appendix A to our letter of October 9,1979, we acknowledge that the raschig rings with the boron content higher than the license requirements evidently provide adequate nuclear safety in the I-D-24A tank.

However, this does not alter the fact that the license specifies the use of borosilicate glass raschig rings of Corning Glass 7740 type or eqvivalent containing a nominal four (4) weight percent natural boron with a range of 11.2 to 13.8 weight percent B7 0 in all your vessels where raschig rings are used for nuclear safety.

The$efore, you must either change the raschig rings in the I-D-24A tank or you must obtain an amendment to your license which allows the use of the raschig rings with the higher boron content.
