Gentlemen:

This will acknowledge receipt of your letter of October 16, 1974, that provided your response to our letter of Septe=ber 23, 1974 and the enclosed Notice of Violation and Proposed I= position of Civil Penalty.

The Septe=ber 23, 1974, Notice of Proposed Imposition of Civil Penalty established the amount of penalty at Four Thousand Dollars ($4,000), as a result of our recent inspection findings relating to a security violation at Three Mile Island Unit 1.

The response of October 16, 1974, outlined ycur position with respect to the proposed i= position of civil penalty and provided information con-cerning the violation found during our recent inspection.

With regard to'your questions concerning whether the violation warranted a civil penalty, it is the Coc=ission's position that a licensee's failure to meet critical security requirements of 10 CFR Part 73 and its implementing security plan in the respect as set forth in the Notice of Violation substantially increases the risk of industrial sabotage, and may adversely affect the public health, safety, or interest.

Failure to control access to the plant facility is a serious violation and is ce=nensurate with the sanction. However, due to the unusual circumstances of (1) a delivery truck protruding through a security gate while being unloaded and which prevented closing the gate for a.short period, and (2) the very limitad access through the gate while the truck was there, the civil penalty is mitigated from Four Thousand Dollars ($4,000) to Three Thousand Five Hundred Dollars ($3,500).

Generally, the corrective action which you propose appears to be appropriate, and we have no futher questions concerning this matter at this time.
