4 Appendix A NOTICE OF VIOLATIOS St. Mary's College License No. 22-00027-06 Based on the inspection conducted on October 12, 1978, it appears that certain of your activities were in noncompliance with NRC requirements, as noted below.

Items 1 through 4 are infractions, and items 5 and 6 are deficiencies.

1.

License Item No. 8.n of the NRC Byproduct Material License No. 22-00027-06 limits the amount of tritium which may be possessed at any oae time to a total of 10 millicuries.

Contrary to this requirement, as of the date of this inspection the byproduct material inventory specified a total of 13 milli-curies of tritium, an amount in excess of the licensed possession limit.

Paragraph 10 CFR 30.3 in Title 10 of the Code of Federal Regulations, Part 30, requires, in par!, : hat a licensee receive, possess and use byproduct material only as authorized in a specific license issued pursuant to these regulations.

Paragraph 10 cra 10.3 in Title 10 of the Code of Federal Regulations, Part 70, states, in part, no person shall receive title to, own, acquire, deliver, receive, possess, use or transfer special nuclear material except as authorized in a license issued by the Commission pursuant to these regulations.

Contrary to these requirements, as of the date of this inspection the isotope inventory reco-d specified possession of 0.03 milli-curies of strontium 90 and 99 microcuries of plutonium 238, items not specifically authorized by NRC license.

License Condition No. 15 of Byproduct bbterial License No.

22-00027-06 specifies that licensed material shall be possessed and used in accordance with statements, representations, and procedures contained in letter dated April 15, 1975.

Contrary to this requirement, as of the date of this inspection smear sampling (surveying) had not been performed as specified.

License Condition bo. 14.A.(1) of Byproduct Material License No. 22-00027-06 specifies, in part, that sealed sources shall be tested for leakage and/or contemination at intervals not 79011701 g

g Appendix A to exceed six months, except that each soorce designated for the purpose of emitting alpha particles shall be tested at intervals not to exceed three months.

Contrary to this requirement, as of the date of this inspection the plutonium-beryllium sealed source had not been leak tested since November, 1977, a period in excess of the specified interval.

License Condition No. 15 of Byproduct Material License No.

22-00027-06 specifies that licensed material shall be possessed and used in accordance with statements, representations, and procedures contained in letter dated January 24, 1975.

Contrary to this requirement, as of the date of this inspection radiation surveys performed had not been documented (recorded) as specified.

6.

Paragraph 10 CFR 30.51(a) in Title 10 of the Code of Federal Regulations, Part 30, requires each person who receives byproduct material pursuant to a license issued pursuant to the regulations, shall keep records showing the receipt, transfer, export and disposal of such byproduct material.

Contrary to this requirement, as of the date of this inspection records of the disposals of byproduct material had not been maintained as specified.
