This refers to the inspection conducted by Mr. C. T. Oberg of this office on October 12, 1978, of activities at St. Mary's College authorized by NRC Byproduct Material License No. 22-00027-06 and to the discussion of our findings with Brother Jerome Rademacher at the conclusion of the inspection.

The inspection was an examination of activities conducted under your license as they relate to radiation safety and to comp 11-ance with the Commission's rules and regulations and with the conditions of your license. The inspection consisted of a selective examinatio.' of procedures and representative records, observations, independent measurements, and interviews with personnel.

During this inspection, certain of your activities appeared to be in noncompliance with NRC requirements, as described in the enclosed Appendix A.

This notice is sent to you pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations. Section 2.201 requires you to submit to this office within twenty days of your receipt of this notice a written statement or explanation in reply, including for each item of noncompliance: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved.

St. Mary's College m the licensed program and verify the adequacy of its health and safety and compliance with NRC regulations.

Consequently, in your reply to this letter, please describe those actions you hav(

taken or plan to take to improve the effectiveness of your adminis-trative control over the license activities to preclude recurrence of these or similar items of noncompliance.

As discussed with Brother Jerome Rademacher by telephone on December 29, 1978, we understand that those materials in your possession which are not specifically authorized by NRC license (0.03 millicuries of strontium 90 and 99 microcuries of plutonium 238) will be kept locked in storage and not used until you have received proper NRC license for them or, that you divest yourselves of these as soon as possible by transfer or disposal to persons authorized by proper licensure to receive the radioisotopes.

Please advise us immediately if our understanding is not correct.

We will gladly diccuss any questions you have concerning this inspection.
