This office has received a copy of your telecopied letter dated Septembcr 20, 1978, requesting an urgent one-time-only Technical Specification change for Brunswick l to extend the inaccessible snubber inspection interval.
In your telecopied application, you stated that it had been determined to be a fee Class II amendment under 10 CFR 170.22 because the change requested was administrative in nature.
- However, your check for $1,200 was never forwarded to us.
In a September 22, 1978 telephone call from Mr. J. McQueen of your Company and an undated telecopied letter received by NRR on September 22, you withdrew your application of September 20.
Since you requested that NRR promptly review your application, review was started and was not discontinued until the telephone call from your staff withdrawing the application.
From our review of your application, we agree that it was properly classified as a Class II because it was administrative in nature. Section 170.12 provides that all application fees will be charged irrespective of the Commission's disposition of an application or your withdrawal of the application.
Because of this and because NRR review had commenced prior to the withdrawal, the fees are still due.
Consequently, you should promptly forward to this office the Class II fee of S1,200 for your September 20 filing.
Fees are payable to the U.S. Nuclear Regu-latory Commission by check, draft, or money order.
