ACKNOWLEDGEMENT OF RESTART OF ACTIONS RELATED TO BEYOND-DESIGN-BASIS FLOODING HAZARD REEVALUATIONS FOR PERRY NUCLEAR POWER PLANT, UNIT 1

Dear Mr. Hamilton:

The purpose of this letter is to acknowledge that FirstEnergy Nuclear Operating Company (FENOC, the licensee) is restarting its activities related to the Perry Nuclear Power Plant, Unit 1 (Perry) reevaluated flood hazard focused evaluation (FE) related to post-Fukushima lessons learned. This letter is in response to the licensee's letter dated August 30, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML19246A004), that notified the U.S. Nuclear Regulatory Commission (NRC) staff of the licensee's intentions in this area.

By letter dated December 7, 2018 (ADAMS Accession No. ML18341A046), as supplemented by letter dated March 20, 2019 (ADAMS Accession No. ML19080A005) the licensee requested deferral of the Perry flooding FE in anticipation of the planned permanent shutdown of Perry in May 2021. By letter dated May 16, 2019 (ADAMS Accession No. ML190936133), the NRC staff found the request acceptable and considered the Perry flooding FE actions deferred until May 31, 2021. The licensee's August 30, 2019, letter notes that by letter dated July 26, 2019 (ADAMS Accession No. ML19207A097), the licensee's certification of permanent cessation of power operations for Perry was withdrawn. The August 30, 2019, letter also stated that FENOC expects to submit the Perry flooding FE by November 22, 2019.

The staff no longer considers the Perry flooding FE to be deferred and will begin its review of the Perry flooding FE upon its submittal. The staff's review will be performed consistent with the guidance described in Nuclear Energy Institute (NEI) 16-05, Revision 1, "External Flooding Assessment Guidelines~ (ADAMS Accession No. ML16165A178). Guidance document NEI 16-05, Revision 1, has been endorsed by Japan Lessons-Learned Division (JLD) interim staff guidance (1SG) JLD-ISG-2016-01, "Guidance for Activities Related to Near-Term Task Force Recommendation 2.1 Flood Haz"ard Reevaluation" (ADAMS Accession No. ML16090A140).
