Dear Dr. Boyle:
The Commission has issued the enclosed Amendment No. 7 to the " possession-only" Amended Facility License No. R-58.
This amendment extends the period of the license for une year until June 19, 1980, and is in response to your application dated May 30, 1979.
Tne enclosed amendment authorizes West Virginia University to possess the AGN-211p reactor and its associated special nuclear and byproduct materials, but not to use any of these items.
Your application further requested that condition 2.C.(4) of the license be amended to allow transfer of the fuel to a suitably licensed party. As stated in our letter of June 13, 1973, you must receive a dismantling order from the Connission authorizing the University to dismantle and dispose of the facility before the facility can be dismantled. Therefore, your request for amendment to condition 2.C.(4) of the license is denied at this time.
It should be submitted as part of your dismantling and disposal plan.
As discussed and agreed to on June 11, 1979, you will submit a physical security plan pursuant to 10 CFR 50.34(c) and 73.40 within 30 days of receipt of this letter.
