Dear Mr. Ragone:

In your letter of May 22, 1979 to Chairman Hendrie you stated that you understand through the news media that the Nuclear Regulatory Connission placed a moratoritri for three months on the issuance of new operating licenses and that fbrth Anna Unit 2 will be affected by this action.

You further indicated that Surry I was shut down unnecessarily and request that Sorry I be returned to service while the remaining pipe stress calculations are completed.

Since rulings and decisions relating to the farth Anna Power Station, Unit 2 could be subject to review by Chairman Hendrie and the other Comissioners, it would not be appropriate for Chairman Hendrie to coment at this time. Accordingly, your letter of May 22, 1979 has been referred to me for response.

As you know, the fRC staff is currently conducting a thorough investigation of the Parch 28, 1979 incident at the Three Mile Island Power Plant, Unit 2.

This investigation includes studies of the potential design deficiencies in the plant,

operator response to the accident including operator errors and/or misinter- ~

pretation of plant instrumentation and all other aspects of the accident which might lead to information that would improve the safety of nuclear power plants.

The results of tnese investigations will also be applied to plants that are currently under construction and for which operating licenses'have been applied for but not yet issued such as the ibrth Anna Powr Station, Unit 2.

Any new safety requirements arising from these investigations will be evaluated to determine whether they are applicable to the Ibrth Anna Power Station, Unit 2 and will be applied to Unit 2 accordingly.

We recognize that these investigations will delay the issuance of an operating license for Unit 2 and that a hardship will be placed on the Virginia Electric and Powr Company. Howver, we are proceeding on the basis that primary con-sideration should be given to the public's health and safety and that our in-vestigation of the Three Mile Island incident should progress to the point where the implications regarding that incident could be assessed to determine the impact, if any, on the North Anna Power Station, Unit 2.

With regard to the shutdcwn Order issued on March 13,1979 for So rry Uni t 1, the facts available at that time were inadeauate to support the continued operation of Surry 1.

Furthermore, in responding to that Order, you did not immediately provide acditicnal factual stress data adequate to support such continued operation.

Mr. Stanley Ragone, President As you know, we expeditiously established a special review team which has been evaluating the additional data you have subsequently developed,valicated ar.J of ficially submitted on the record.

As of June 4,1979, there still remains some data which you ;tave not yet provided. We continue to stand ready to evaluate the tec5nical bases, as you submit them, that demonstrate the sei smic adequacy of your present safety related piping systems and supports including any modifications that may be necessary to remove inadequacies, or any new design bases, that, if acceptable, would eliminate the need for such modifications.

We trust that you will continue to cooperate by supplying the additional data needed to support a restart of Surry 1.
