May 31, 1979 MEMORANDUM AND ORDER Fursuant to the Board's.!c rlier instructions, counsel for the NRC Staff under covering letter dated February 16, 1979, forwarded to the Board copies of the environmental technical specifications which have been prepared for attachment to the proposed full-term operating license for the Oyster Creek facility. I The Staff notes, however, that because this facility is being evaluated by the Office of Nuclear Reactor Regula-tion under the Systematic Evaluation Program, it will be at least two years before a full-term operating license could be issued.

Therefore, the Staff proposes to make the environmental technical specifications part of the Oyster Creek provisional operating license issued by the Com-mission in 1969.

The Applicant has agreed to the imposition of these speci-fications.

Copies were sent by the Staff to several addressees on November 3,1978, but the cover letter erroneously addressed two board members.

The Board has reviewed the proposed environmental technical speci-fications and finds them acceptable.

Since the parties to this proceeding have been able to mutually resolve the issues in controversy and the Board has now approved the environmental technical specifications, there are no other matters presently before the Board warranting our attention.

Therefore, we are in a position to rule on the outstanding " Joint Motion to Terminate Hear-ing" filed by counsel for the NRC Staff on November 14, 1975, but for one further concern.

In this regard, the Staff is requested promptly to advise the Board of its evaluation of the significance of the recent coolant flow reduction incident at Oyster Creek which was reported in the May 24, 1979, issue of ikcleonics Week.

Dr. Hugh C. Paxton and Dr. Paul W. Purdom, Board Members, join in and concur with this Memorandum and Order.

It is so ORDERED.
