INTRODUCTION By letters dated September 18, and October 12, 1979, Jersey Central Power

& Light Company (the licensee) requested a supplement to the March 3,1978 Fire Protection Safety Evaluation Report supporting Amendment No. 29 to Provisional Operating License No. DPR-16 for the Oyster Creek Neclear Generating Station (the facility). Tne supplement would defer the completion date for the remote shutdown station until completion of the Systematic Evaluation Program (SEP) Review and would defer the completion date for several modifications until the next refueling outage.

DISCUSSION On March 3,1978, the Comission issued Amendment No. 29 to License No. DPR-16 for Oyster Creek. The amendment added a condition to the license which required completion of the modifications identified in paragraphs 3.1.1 through 3.1.23 of the NRC's Fire Protection Safety Evaluation (FPSE) for Oyster Creek dated March 3,1978. Such modifications are to be completed by July 1980, except for the remote shutdown station which is required to be implemented by no later than the end of the 1980 refueling outage.

On June 29, 1979, the Comission issued Amendment No. 38 to License No. DPR-16 for Oyster Creek. The Amendment granted a limited extension of the scheduled completion dates for Sprinkler Systems and hose stations and allowed some changes to some of the modifications being made to improve the level of fire protection at the facility. Amendment No. 38 war supported by Supplement No.1 to the Fire Protection Safety Evaluation Report.

EVALUATION By letter dated September 18, 1979, the Licensee requested that the schedule for Item 3.1.23 of Table 3.1 in the Fire Protection Safety Evaluation Report

" Remote Shutdown Station" be deferred until completion of the SEP review. The reason provided by the licensee for deferring the schedule for this item is that various topics currently being reviewed within the SEP (e.g., Topic VII-3

" Systems Required for Safe Shutdown", Topic VII-4 " Effects of Failures in Nonsafety Related Systems on Selected Engineered Safety Features," and Topic XV-24 " Loss of All AC Capability")may result in additional requirements or modification of the alternate shutdown capability. Since the 3EP requirements could affect various parameters (e.g., location, size, instrumentation, operational capabilities, etc.), sufficient information is not available to design a system that addresses all possible concerns.

Because of the fire modifications that have been implemented, the remainder that will be completed in the near future (see Table 3.1), the augmented shift size, the administrative controls in effect and the possible changes in the requirements for the remote shutdown station we conclude that the requested deferral for implementation of the remote shutdown station until completion of the SEP review is acceptable.

By letter dated October 12, 1979 the licensee requested that the schedules for Items 3.1.1, 3.1.2, 3.1.3, 3.1.4, 3.1.5, and 3.1.15 of Table 3.1 be modified to coincide with the refueling octage scheduled for January 1980. 'ihese items concern modifications that must be completed in areas where safety equipment is installed, where high radiation levels exist during operation, or the modi-fications require removing safety equipment from service during installation.

The original schedule for these items was based on a tentatively planned refueling outage of October 1979.

Because of the extended shutdown that occurred during this operating cycle, the outage has been rescheduled for January 1980. We have concluded that the safety of operation or the health and safety of the public will not be significantly affected by delaying completion of these items for approximately three months until the next scheduled refueling outage. However, if an unscheduled outage of sufficient duration to implement the modifications occurs prior to the scheduled refueling outage the modifications shall ce perfomed at that time. On this basis, we find the proposed schedule change acceptable.

The licensee has implemented many of the modifications identified in Table 3.1 of the FPSE. During the past year, fire protection at tha Oyster Creek Station has been significantly upgraded including augmentation of the shift crew to include adequate personnel to manually shutdown the plant and also respond to any fire emergency. Ten individuals are assigned to each shift, five of whom are designated to shutdown the plant remotely, if necessary, and five whom are designated to respond to any fire which may occur. All personnel assigned responsibility to respond to a fire have been appropriately trained in fire fighting techniques and participate in periodic fire drills.

CONCLUSION Because of the fire protection modifications that have been implemented, the renainder that will be completed in the near future (see Table 3.1), the augmented shift size the administrative controls in effect and the possible changes in the requirements for the remote shutdown station, we conclude that the requested deferral for implementation of the remote shutdown station until completion of the SEP review is acceptable. We also conclude that the requested deferrals will not result in an unacceptable risk to the healtn and safety of the public and do not affect conclusions made in the FpSE dated fiarch 31, 1978; therefore, the attached Table 3.1 is modified by this Supplement as indicated.
