Docket No. 50-239 Cperating License :To. DFR-50 By letter dated July 29, 1977, you i equested Met-Ed to provide as'2 ' *icnal justification that the information on Tables h-1 and h-3 of the Tu ee Mile Island Nuclesr Station, Unit 1 Cycle 3 Reload Report is proprietary in nature in accorduce with 10 CFR 2.790(b). The reasons for '4et-Ed's request were given in an affidavit transmitted by cur letter of February 25, 1977 A previously submitted reload application has contained the sa::e proprietary information (e.g. SA*4-lh25, "Cconee Unit 2, Cycle 2 Reload Report").
At thst time the NEC also requested that the prcprietary nature of this infor ation be juctified. Ey letter dated April 1,1977, Mr.

O. Parker, Jr. from Duke Fever Campany provided such justifiestion to Mr. A. E. Schwencer of the NRC.
Mr. Schwencer's letter dated June 22, 1977 (Oceket No. 50-270) provided Duke Pcver Ccepany with the NRC's favorable ruling on maintaining the proprietary natura of thi3 in f ormat ion.
Since the NRC has previcusly "uled that this information is proprie arg, we believe that an 9dditional affidavit justifying the proprietary nature ' f this o
information is unwarruted. Therefore, in view of the above discussed ruling, ve request that the infor-aticn on Tables 4-12nd h-3 cf the Three Mile Island Nuclear Station, Unit 1, Cycle 3 Relosd Report be considered proprietary in nature and withhela from public lisclosure.
