APPENDIX A NOTICE OF VIOLATION Combustion Engineering, Inc.

Docket No. 70-1100 Based on the results of an NRC inspection conducted en March 28-30, 1979, it appears that certain of your activities were not conducted in full compliance with the conditions of your license as indicated below.

Items A, B, and C are infractions.

A.

Condition 9 of Special Nuclear Material License No. SNM-1067 incorporates Section 8 of the licensee's application.

Section 8.2 of the licensee's application requires " written operating procedures."

Section 4.6 of the Nuclear Licensing and Safety Procedures manual, developed pursuant to the above, states "A Radiation Work Permit should be secured for any operation in which the normal containment and/or ventilation is made less effective."

Contrary to the above, on March 30, 1979, the containment and ventilation were made less effective on the Centerless Grinder in the Pellet Shop in that containment (Plexi-Glass) surrounding the Centerless Grinder had been removed on three sides and there was no airflow into the Centerless Grinder, and a Radiation Work Permit was not secured.

B.

Condition 9 of Special Nuclear Material License No. SNM-1067 incorporates Section 15 of the licensee's application.

Section 15.3.4 of the licensee's application states that a removable beta level of 5,000 dpm/100cm requires cleanup within 24 hces in Health Physics restricted areas.

Section 15.3.5 of the licensee's application states that a maximum removable beta level of 2000 dpm/100 cm is permitted in clean areas.

Contrary to the above, the licensee does not make surface contamination surveys to determine the beta contamination levels in restricted areas or clean areas, in Buildings No. 5 and 17, according to licensee representatives.

C.

Condition 9 of Special Nuclear Material License No. SNM-1067 incorporates Section 15 of the licensec's applicatiori.

Section 15.10 of the licensee's application requires personnel to monitor prior to leaving unclad fuel handling areas.

Contrary to the above, an employee exited the Ceramics Lab of Building No. 5, an unclad fuel handling area, on March 29, 1979, and he did not monitor as required, as observed by the inspector.
