Confirmation of Effective Date: Part 72 of Title 10 of the Code of Federal Regulations C10 CFR) (Regulatory Identifier Number CRIN) 3150-AK33: NRC-2019-0070)

On July 19, 2019, the NRC published a notice in the Federal Register (84 FR 34769) confirming the effective date of July 29, 2019, for the direct final rule that was published in the Federal Register on May 15, 2019 (84 FR 21687). This direct final rule amended the NRC's spent fuel storage regulations by revising the NAC International NAC-UMS Universal Storage System listing within the "List of approved spent fuel storage casks" to include Amendment No. 7 to Certificate of Compliance No. 1015. Amendment No. 7 revises the surveillance requirements for technical specifications A3.1.6.1 and A3.1.6.2 to ensure that adequate monitoring of the concrete cask heat removal system is performed. Amendment No. 7 also revises the basis for technical specification A3.1 .6 to clarify that the surveillance requirements for technical specification A3.1.6 requires a minimum of two outlet air temperature measurements to provide an average outlet temperature. The effective date of July 29, 2019, for the direct final rule published May 15, 2019, is confirmed .

State of Vermont: NRC Staff Assessment of a Proposed Agreement Between the Nuclear Regulatory Commission and the State of Vermont: Proposed State Agreement: Request for Comment: 10 CFR Part 150 CNRC-2019-0114)

On July 16, 2019, the NRC published in the Federal Register(84 FR 33864) a notice of proposed agreement between the NRC and the State of Vermont requesting public comment on the agreement. By letter dated April 11 , 2019, Governor Philip Scott of the State of Vermont requested that the NRC enter into this agreement as authorized by Section 274b. of the Atomic Energy Act of 1954, as amended (AEA). Under the proposed agreement, the Commission would discontinue, and the State of Vermont would assume, regulatory authority over certain types of byproduct materials as defined in the AEA, source material, and special nuclear material in quantities not sufficient to form a critical mass. The NRC is also publishing the summary of a draft assessment by the NRC staff of the State of Vermont's regulatory program.

Comments are requested by July 25, 2019, on the proposed agreement and its effect on public health and safety. Comments are also requested on the draft staff assessment, the adequacy of the State of Vermont's program , and the State's program staff.

Section 27 4e. of the AEA requires that the terms of the proposed agreement be published in the Federal Register for public comment once each week for four consecutive weeks. This document is the final notice being published in fulfillment of that requirement.

Physical Security for Advanced Reactors: Regulatory Basis: Public Meeting and Request for Comment: 10 CFR Parts 50, 52, and 73 CRIN 3150-AK19: NRC-2017-0227)

On July 16, 2019, the NRC published a document in the Federal Register (84 FR 33861) requesting comment on a regulatory basis to support a rulemaking that would amend the NRC's regulations to develop specific physical security requirements for advanced reactors, which refers to light-water small modular reactors and non-light-water reactors . The NRC is proposing a limited-scope rulemaking , which would provide a clear set of alternative, performance-based requirements and guidance for advanced reactor physical security that would reduce the need JULY 26, 2019 ENCLOSURE C

for exemptions to current physical security requirements when applicants request permits and licenses. The NRC plans to hold a public meeting to discuss the regulatory basis and facilitate public participation. Comments are requested by August 15, 2019.

Measurement Standards Used at U.S. Nuclear Power Plants: Petition for Rulemaking; Correction: 10 CFR Parts 50 and 52 (Docket No. PRM-50-118; NRC-2019-0071)

On July 15, 2019, the NRC published a document in the Federal Register (84 FR 33710) correcting a notice that was published in the Federal Register on May 15, 2019 (84 FR 21728),

regarding the receipt of a petition for rulemaking from Michael Taylor, dated December 3, 2018, as amended on January 24, 2019. This action is necessary to correct a Docket ID and telephone number. The correction was effective July 15, 2019.
