On November 30, 2017, Exelon Generation Company (Exelon) submitted a request for approval of the Oyster Creek Nuclear Generating Station (OCNGS) Decommissioning Quality Assurance Program (DQAP) (Reference 1). The DQAP is associated with Docket Nos. 50-219 and 72-15. Subsequently, Exelon submitted a revision to the DQAP to address an NRC Request for Additional Information (RAI) (Reference 2). As described in the request for approval and the RAI response, the OCNGS DQAP assures compliance with 10CFR 71, Packaging and Transportation of Radioactive Material, Subpart H Quality Assurance. The DQAP, Revision 0 was approved by letter from the NRC dated June 27, 2018 (Reference 3).
There have been no changes to the DQAP since approval by the NRC.
By Order dated June 20, 2019 (Reference 4) the NRC approved the transfer of license DPR-16 for OCNGS from Exelon Generation Company, LLC to Oyster Creek Environmental Protection, LLC (OCEP) as the licensed owner and Holtec Decommissioning International, LLC (HDI) as the licensed operator. OCEP and HDI are both wholly-owned subsidiaries of Holtec International. The transfers to OCEP and HDI were enacted on July 1, 2019. The existing Oyster Creek programs and procedures at the time of transfer, including the DQAP, Revision 0 have been adopted by HDI and are being implemented by HDI and the Decommissioning General Contractor (DGC) Comprehensive Decommissioning International (CDI).
HDI is aware that Exelon plans to request that the common 10 CFR Part 71 Quality Assurance Program Approval No. 0008 for Radioactive Material Packages, Docket Number 71-0008, issued tor Exelon be revised to delete OCNGS from the list of applicable locations.
The purpose of this letter is to notify the NRC, in accordance with 10 CFR 71.1, that HDI will apply the OCNGS DQAP approved by NRC in Reference 3 to Radioactive Material Packages.
HDI requests NRC to issue a Quality Assurance Approval for Radioactive Material Packages (NRC Form 311) for OCNGS as required by the Quality Assurance Program Requirements of 10 CFR 71.101(b) in accordance with 10 CFR 71.101(f).
