VERMONT YANKEE NUCLEAR POWER STATION - ISSUANCE OF ENVIRONMENTAL ASSESSMENT AND FINDING OF NO SIGNIFICANT IMPACT RELATED TO REQUEST FOR EXEMPTION FROM 10 CFR 50.82(a)(8)(i)(A) (L-2018-LLE-0007)

Dear Mr. State:

Enclosed is a copy of the Environmental Assessment and Finding of No Significant Impact regarding the request from NorthStar Group Services, Inc. (NorthStar) for an exemption from Title 10 of the Code of Federal Regulations (10 CFR) 50.82(a)(8)(i)(A), dated May 25, 2018.

The exemption is to allow the use of up to $20 million of funds from the Vermont Yankee Nuclear Power Station (VYNPS) nuclear decommissioning trust fund (NDT) for purposes of managing irradiated fuel on a revolving basis.

The proposed action would exempt NorthStar from the requirements of 10 CFR 50.82(a)(8)(i)(A) which states that decommissioning trust funds may be used by licensees if the withdrawals are for expenses for legitimate decommissioning activities consistent with the definition of decommissioning in 10 CFR 50.2. Since the definition of "decommission" in 10 CFR 50.2 does not include activities associated with irradiated fuel management, an exemption from 10 CFR 50.82(a)(8)(i)(A) is needed to allow NorthStar to use NDT funds for irradiated fuel management.

This exemption was requested in relation to the application from Entergy Nuclear Operations, Inc., on behalf of itself and of Entergy Nuclear Vermont Yankee, LLC (ENVY, to be known as NorthStar Vermont Yankee, LLC or NorthStar VY), and NorthStar Nuclear Decommissioning Company, LLC, to transfer the license for the VYNPS. The exemption would only apply following approval of the license transfer application by the U.S. Nuclear Regulatory Commission, and closing of the underlying transaction.

The Environmental Assessment and Finding of No Significant Impact is being forwarded to the Office of the Federal Register for publication.
