OF THE MAY 23, 2018, CATEGORY 1 PUBLIC TELECONFERENCE WITH NUSCALE POWER, LLC - MEETING TO DISCUSS THE NUSCALE POWER INITIAL TEST PROGRAM REVIEW The U.S. Nuclear Regulatory Commission (NRC) staff held a Category 1, public teleconference with NuScale Power, LLC (NuScale) on May 23, 2018, to clarify the review approach to the NuScale Final Safety Analysis Report Section 14.2, Initial Plant Test Program, that incorporates a risk-informed approach to the NuScale design.

The public meeting notice can be found in the Agencywide Documents Access and Management Systems under Accession No. ML18141A656. This meeting notice was also posted on the NRC public Website.

The meeting summary, agenda and list of participants can be found in Enclosures 1, 2, and 3, respectively.

OF THE MAY 23, 2018, PUBLIC TELECONFERENCE MEETING WITH NUSCALE POWER, LLC, REGARDING THE NUSCALE INITIAL TEST PROGRAM The purpose of the teleconference was to introduce the U.S. Nuclear Regulatory Commissions (NRC) proposed initial test program review.

The NRC staff started the call with a brief discussion of the memo dated March 27, 2018, entiled Review Approach and Expectations for the NuScale Power, LLC (NuScale), Initial Test Program (Agencywide Documents Access and Management Systems (ADAMS) Accession No. ML18074A124) from Tim McGinty, Director Division of Construction Inspection and Operational Programs, Office of New Reactors (NRO) , to the NRC technical staff and provided a status of branch responses as required by the May 15, 2018, due date. This review approach is also discussed in the memo dated March 7, 2018, entitled Proposed Pilot Approach for the NuScale Power, LLC, Initial Test Program Review, (ADAMS Accession No. ML18060A298) from Tim McGinty to Frank Akstulewicz, NRO, Director of New Reactor Licensing.

NuScale had no questions on the approach that the NRC staff was taking as described in the memo. The NRC staff discussed some additional issues with NuScale so that they had an idea of where additional or new testing may be needed. These areas included the Low Temperature Overpressure Protection (LTOP) system, Title 10 of Code of Federal Regulations (CFR), Part 50, Appendix J, Integrated Leakage Rate Testing, and the reactor coolant system.

NuScale requested information regarding which test abstracts the NRC staff would be reviewing as part of the design certification (DC) application. The NRC staff informed NuScale that identification of the specific test abstracts is part of the second review scope described in the March 27, 2018, memo and that NRC should have that information for NuScale no later than June 29, 2018. The NRC staff plans to have another public meeting with NuScale in July 2018 to discuss any remaining outstanding issues with the test abstracts that were reviewed by the staff.

The next topic of the meeting was a high level discussion of NuScales options as it pertains to the test abstracts that will not be reviewed by the NRC staff during the DC application review, i.e., information can be removed from the final safety analysis report (FSAR) or as the NRC staff writes the final safety evaluation report (FSER) and rule limiting the finality to only the test abstracts reviewed. Since NuScale did not have their General Counsel present for the call, they requested another public meeting to discuss this topic.

NuScale also wanted to know what was driving the change to the review. The NRC staff stated that the review of FSAR Chapter 14.2 Initial Plant Test Program, requires the services of the same technical staff that review the technical chapters and that they need to complete the technical chapters prior to focusing on initial test program (ITP). The NRC staff reminded NuScale that the regulations for a DC do not require an ITP, whereas the regulations for a combined license (COL) require an ITP. The NRC staff stated that it looked like the information provided in the FSAR would require significant requests for additional information to resolve the missing information consistent with standard review plan (SRP) Section 14.2 and that the revised approach would maintain the current review schedule.
