NOTICE OF VIOLATION

(INSPECTION REPORT NOS. 50-280/91-37 AND 50-281/91-37)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

Mr. M. W. Branch of this office on December 1, 1991, through January 4, 1992.

The inspection included a review of activities authorized for your Surry

facility.

At the conclusion of the inspection~ the findings were discussed

with those members of your staff identified in the enclosed inspection report *

Areas examined during the inspection are identified in the report.

Within

these areas, the inspection consisted of selec.tive -examinations-of procedures

and representative records, interviews with personnel, and observation of

activities in progress.

Based on the results of this inspection, certain activities appeared ~o be in

violation of NRC requirements, as specified in ~he enclosed Notice of Violation

(Notice).

We are concerned about the violation because it involved the

operation of the RCS letdown- system with a piping weld leak without requesting

NRC relief from ASME code requirements.

Recent NRC guidance in this area,

which was communicated to you in Generic Letter 91-18, clearly indicated that

relief from code requirements is required in this type of situation.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response.

In your

response, you should document the specific actions taken and any additional

actions you plan to prevent recurrence. After reviewing your response to this

Notice, including your proposed corrective actions and the results of future

inspections, th~ NRC will determine whether further NRC enforcement action is

necessary to ensure compliance with NRC regulatory requirements.
