Citizen Complaint and Request for Enforcement Action Regarding FirstEnergy Nuclear Facility Operations in Ohio and Pennsylvania Margrethe Kearney Andrene Dabaghi Environmental Law & Policy Center 35 E. Wacker Drive, Ste. 1600 Chicago, IL 60601 (312) 673-6500

Dear Margrethe Kearney and Andrene Dabaghi,

Thank you for your email dated May 2, 2018.

To complete the Petition Review Boards (PRBs) review and provide a timely response on your petition consistent with the process outlined in MD 8.11, the PRB plans to hold its next internal review meeting on June 12, 2018. As indicated in MD 8.11, the intent of this PRB meeting is, in part, to determine whether or not your request meets the criteria for review as a 10 CFR 2.206 petition, and to develop a schedule for responding to the petition.

Consistent with MD 8.11, on April 16, 2018, I offered you an opportunity to give a presentation to the PRB, either by telephone or in person, prior to the PRBs internal meeting to review the petition. This is an opportunity for you to provide any relevant additional explanation and support for the requests and facts of the petition. Please notify me as soon as possible if you wish to request such an opportunity, and if so, whether you prefer to make the presentation by telephone or in person at the NRC HQ. If you request this opportunity, please also provide your availability to meet with the PRB, and in particular, identify any dates between now and June 1st when you would not be available. If you choose to meet with the PRB in person, NRC policy requires the meeting be noticed in the NRC public meeting notice system (PMNS) at least 10 days before the meeting. To allow sufficient time to issue the meeting notice, the meeting details need to be finalized approximately two weeks prior to the meeting date. For example, if the meeting details were finalized today, May 7th, the earliest the public meeting could occur is May 21st. The MD 8.11 does not require noticing a teleconference in PMNS, so there is greater flexibility if you choose that option.

If you wish not to make a presentation to the PRB, the PRB will proceed with its initial assessment of the petition based on the information provided in your March 27, 2018 petition, and will inform you of the results or if additional information is needed to complete its assessment.

Please do not hesitate to contact me if you have any questions on the above or the petition process.

Thank you, Bhalchandra K. Vaidya Licensing Project Manager NRC/NRR/DORL/LPL3 (301)-415-3308 (O) bhalchandra.vaidya@nrc.gov 1
