Wacker Drive, Ste. 1600 Chicago, IL 60601 (312) 673-6500 Margrethe Kearney and Andrene Dabaghi, On April 30, 2018, the NRC Petition Review Board (PRB) met internally to discuss whether the petition you submitted on behalf of the Environmental Law and Policy Center contains a specific request for immediate action(s) and whether the petition contains information that would warrant immediate NRC action. Although the petition requested immediate emergency consideration, based on the information provided in the petition, the PRB concluded that there is no current public health and safety concern that requires immediate NRC action. The PRB considered the safety significance of the concerns raised in your petition dated March 27, 2018, and determined that the financial concerns do not raise an imminent safety issue or indicate that the licensee, FirstEnergy Nuclear Operating Company (FENOC), is unable to safely operate the facilities listed in the petition. However, the PRB will continue to evaluate your petition in accordance with 10 CFR § 2.206 and the NRC Management Directive 8.11 process.

The next step is for the PRB to assess whether your petition meets either the acceptance or rejection criteria listed in MD 8.11, Part III Section C. If you would like an opportunity to address the PRB in person or via teleconference to provide supplemental information prior to this assessment, please let me know at your earliest convenience. Otherwise, the PRB will proceed to assess the acceptability based on the information provided in your March 27, 2018, petition.
