NUCLEAR REGULATORY COMMISSION (10-2000) 10 CFR 72 PAGE 1 OF 2 PAGES LICENSE FOR INDEPENDENT STORAGE OF SPENT NUCLEAR FUEL AND HIGH-LEVEL RADIOACTIVE WASTE Pursuant to the Atomic Energy Act of 1954, as amended, the Energy Reorganization Act of 1974 (Public Law 93-438), and Title 10, Code of Federal Regulations, Chapter 1, Part 72, and in reliance on statements and representations heretofore made by the licensee, a license is hereby issued authorizing the licensee to receive, acquire, and possess the power reactor spent fuel and other radioactive materials associated with spent fuel storage designated below; to use such material for the purpose(s) and at the place(s) designated below; and to deliver or transfer such material to persons authorized to receive it in accordance with the regulations of the applicable Part(s). This license shall be deemed to contain the conditions specified in Section 183 of the Atomic Energy Act of 1954, as amended, and is subject to all applicable rules, regulations, and orders of the Nuclear Regulatory Commission now or hereafter in effect and to any conditions specified herein.

9. Authorized Use:

The material identified in 6.A and 7A above is authorized for receipt, possession, storage, and transfer.

For use in accordance with the conditions of this license and the attached Technical Specifications. The basis for this license was submitted in the Safety Analysis Report application dated February 4, 1985, as supplemented on March 10, April 3, April 22, May 21, July 10, July 22, and October 31, 1986; January 2, February 17, November 25, August 11, September 9, and December 16, 1988; January 9, January 11, February 1, April 28, June 2, and June 29, 1989; November 1, 1993; January 11 and March 26, 1999; August 28, 2000; September 3, 2003, and February 27, 2004.

10. Authorized Place of Use: The licensed material is to be received, possessed, transferred, and stored at the H.B. Robinson Independent Spent Fuel Storage Installation located on the H.B. Robinson Steam Electric Plant, Unit 2, site in Darlington County, South Carolina, as described in the Safety Analysis Report.
11. The Technical Specifications contained in Appendix A attached hereto are incorporated into the license.

The licensee shall operate the installation in accordance with the Technical Specifications in Appendix A.

12. The Safeguards License Condition contained in Appendix B attached hereto is hereby incorporated into the license. The licensee shall maintain a facility physical security program in accordance with this condition.
13. The Technical Specifications for Environmental Protection contained in Appendix C attached hereto are incorporated into the license. The licensee shall operate the installation in accordance with the Technical Specifications in Appendix C.
14. Pursuant to 10 CFR 72.7, the licensee is hereby exempted from the provisions of 10 CFR 72.122 (i) with respect to providing instrumentation and control systems for the NUHOMS-7P dry shielded canister and horizontal storage module (DSC and HSM) during storage operations.
15. The Safety Analysis Report supplement submitted pursuant to 10 CFR 72.42(b) on February 27, 2004, describes the aging management program for the H.B. Robinson Steam Electric Plant, Unit 2, Independent Spent Fuel Storage Installation. The aging management program includes inspections and surveillances required by the H.B. Robinson Steam Electric Plant, Unit 2, Independent Spent Fuel Storage Installation Technical Specifications. Evaluation of the results of these activities for adverse trends ensures that no significant deterioration of the Independent Spent Fuel Storage Installation occurs undetected.

Based upon the requirements, the Commission finds that the licensees request to be exempted from the provisions of 10 CFR 72.42(a), with respect to the 20 year license period, is authorized by law and will not endanger life or property or the common defense and security and is otherwise in the public interest. Pursuant to 10 CFR 72.7, the Commission hereby grants the exemption.

16. This license is effective as of the date of issuance shown below.
