NON-EMERGENCY EVENT NOTIFICATION, 10 CFR 50.72, SALEM NUCLEAR GENERATING STATION, UNITS 1 AND 2, AND HOPE CREEK GENERATING STATION
{TAC NOS. M93350, M93351 AND M93352)
Dear Mr. Eliason:
In a letter dated August 25, 1995, you requested relief from the 4-hour notification requirements of 10 CFR 50.72(b)(2)(vi). Specifically, you requested relief from reporting minor exceedances of the New Jersey opacity standards for diesel generators and auxiliary boiler, and minor exceedances of the New Jersey Pollutant Discharge Elimination System permit effluent limitations for conventional, non-toxic pollutants, such as residual chlorine, suspended solids, temperature and sewage limits.
The request is similar to your September 2, 1992, letter regarding minor non-radioactive chemical spills.
In our October 19, 1992, letter we determined that such spills need not be reported under Section 50.72(b)(2)(vi),
consistent with guidance in a draft of NUREG-1022.
Therefore, consistent with the advice which we previously provided in 1992, our interim position on your most recent request is that until a final revision to NUREG-1022 has been issued, these two exceedances of State limits need not be reported to the NRC under Section 50.72(b)(2)(vi).
However, as stated in our October 19, 1992 letter, when the final revision to NUREG-1022 is published, you must verify the*staff's final position, and determine whether a request for relief is appropriate at that time.
Our interim advice on this matter does not constitute a staff position for purposes of the Backfit Rule, 10 CFR 50.109.
